Hi

If a Permanent Resident:
- stays 2 continuous years in a raw in Canada, then immediately after

- leaves Canada for say 10 months and files as Non-resident status during the 3rd year (more than 183 days outside rule).

- At the end of the 3rd year, he comes back and updates his status back to Permanent-Resident.

So all in all he was Permanent Resident more than 3 years ( 34 months = 24 + 10) within the 4 consecutive years.

Can he still apply for citizenship ? Or the 10 months spent outside during the 3rd year would screw up the process ?

Being a non-resident does not prevent someone from applying for citizenship. The rule they have to meet is 3 years of residency in Canada in the last 4 years. If 10 months of that was spent outside of Canada as a non-resident, that won't be an issue provided the residency requirement is met.

- I assume that as consequence, he will be considered as Non-Resident for Tax purposes for the 3rd year ?
- Nothing to file for T1 Income Tax then, he will be treated as Foreigner ? Right ?
