CIC transformed application sponsoring spouse to humanitarian circumstances

Hi Folks , here is my case , I sponsored my wife to come to Canada as permanent resident, CIC had received my application back on Jan 2017, after one yr I got a letter telling me they transformed application from (sponsoring spouse to HC humanitarian circumstances ) because I wasn’t attended to our celebration for marriage! , and CIC asked me to send a justification letter why I wasn’t be able to attend, which I did

Since my replay to their request (Jan 2018) , I keep filling in a form to know where they arrived in studding the application of my wife , AND they keep answering me SAME answer like (we are processing you application thank you for your patient etc..) up to today!

So 2 yrs since they received application I’m still getting same answer (usually the normal delay is 1 yr ) , application is in process by agent visa from outside of Canada

My question to you folks:

- What I can do after this double delay of processing time?

- is there any way to make advance our file?

- is there any authority to talk to make a complain about this long delay ?

Have you ordered your GCMS notes to see what they say? If not, that's the first thing I would do.

IRCC doesn't recognize proxy marriage, so if you didn't attend the marriage, then you are not considered legally married. Frankly, you are lucky that IRCC is even considering your app as H&C; they should have just straight-up refused it.

canuck_in_uk , do you think IRCC considered my application as HC because i do have beautiful eyes! , no sir , as i mentioned above , i did explained my situation to IRCC that 's why they considered as HC , so when i explained my situation i didn't want to go deep explaining every details ,thank you for considering me a lucky , wasn't better if you give me a solution AS Scylla did,
your replay will give a bad impression to whom they were willing to help, that why i replayed to you , but again if you have any suggestion it could help i will appreciate it :)

Not a sir...

Proxy marriage apps are refused. The fact that they are considering yours as H&C is very unusual. The suggestion is have patience and don't complain that they are actually considering your app when they should have just refused it.

scylla certainly gave good advice in telling you to apply for GCMS notes but I think canuck_in_uk was answering your questions directly.

- What I can do after this double delay of processing time? - nothing because there is no delay. H&C applications take a LONG time, there are no guaranteed maximum times.

- is there any way to make advance our file? - same answer above

- is there any authority to talk to make a complain about this long delay ? - no one as there is no delay

I think what canuck_in_uk is telling you is that patience is your only option at this point because your case is not a straight forward spousal sponsorship application (and therefore not included as part of the government's promise to complete within 12 months 80% of the time) as proxy marriages are not recognized by IRCC. H&C cases take a really long time and that IRCC even considered continuing to process your application when they had every right to legally refuse it from the start is unusually kind and considerate of them. Best of luck and keep being patient.

For Humanitarian ad Compassionate cases the processing time is 22-36 months and sometimes even more, depending on the case itself....not 12 months (1 year). So it seems your are still within the time frame. Its best you just order the GCMS notes to know more about your case.
