Hi all,

I am an Indian on study permit to Canada and my wife is on a open work permit.

We are expecting our baby in the next year. I had a confusion - Can I apply for Canadian passport for my baby, given the fact that we dont have a PR in Canada?

Let me know your expert views. Any reference would also be of much help.

Thank you.

If your kid is born in Canada regardless the status of parents he/she will be a Canadian by birth however if the parents are diplomats then the kid's nationality will be same as his/her parents.

Thanx OKK,

However, I just read on wikipedia that the parents need to be either PR or citizen of Canada to get the Canadian passport for the child.

(See "Birth in Canada")

An added confusion. Hope you dont mind resolving it.

Thanks again

1. As explained earlier, a child born in Canada (other than to diplomats) is a Canadian citizen (no matter what a Wiki states)
2. As a Canadian citizen, the child is entitled to a Canadian passport.

You read it incorrectly - wikipedia states
"Canadian citizenship is typically obtained by birth in Canada, birth abroad when at least one parent is a Canadian citizen and was born or naturalized in Canada, or by adoption abroad by at least one Canadian citizen."

If your baby is born in Canada then it will have Canadian citizenship by birth as mentioned in wikipedia - birth in Canada

Dude if your kid is born in Canada he/she is a Canadian plain and simple unless like i said earlier if you are diplomats then your kid will have the nationality you are.
So after the birth take that birth certificate and apply for that Canadian passport. Good Luck.
