Hello,

My wife and I are both PR card holders. Our child was born outside Canada. We got her TRP and brought her with us to Canada. Then I applied for her sponsorship but CIC has put her application under Humanitarian and Compassionate grounds. According to them this is the only way a dependent child can be sponsored inside Canada. Now my concern is that her TRP is expiring early next year while her application is only a year old. The website states that it can take from 30 to 42 months to process such applications. What do you suggest how can I accelerate her process. Secondly you think her TRP can be renewed easily if I say her PR application is under processing.

H and C is difficult to prove and slow. You should have filed outland.
There is no way to make it go faster. You can try to extend the TRP, but I'm not certain how that works or if you can extend a TRP (I know you can apply to extend a TRV, but those are different things).

I really don't understand why CIC put the child under H&C application route. Doesn't make sense to me. If I were in your shoes I would have applied through inland family sponsorship. Are you sure you didn't submit it through Family inland sponsorship? I can't see CIC arbiatarily change the family inland to H&R route unless they told you this before you submitted your application.

If you are sponsoring only a child, then there is no inland route, which is why it's going as H&C. A child can only be sponsored through the inland route if they are a dependent of your spouse (ie you are sponsoring your spouse and including the child in the application).

It would probably be far quicker to withdraw the application and resubmit an "outland" one.

I was just thinking what zardoz said. Also check your visa office processing times and during which stage they may ask for passport.

I got to say, that has got to be the dumbest route that CIC has come up with for a PR parent to sponsor their own child within Canada. CIC ought to make another special sponsorship for child sponsorship within Canada.

Do you think if I submitt an "Outland" application, can I still renew her TRP? Else if you believe its difficult maybe I can apply for TRV inside Canada - not sure if I can do that or not?

You cannot apply for TRV within Canada. You can keep extending the visitor stay within Canada since child is already in Canada. If the child was outside Canada, then it would be very difficult for the child to get TRV once PR papers are submitted. But in your case, it is not an issue.
