1)We are on super visa for last one year and our son is studying as international student in 8th class in Canada. can we get child care benefit
2) If I get Work permit then what is the situation regarding child care benefit

No you are not eligible.

  • You are a resident of Canada for tax purposes
  • You or your spouse or common-law partner must be any of the following:
    • a Canadian citizen
    • a permanent resident
    • a protected person
    • a temporary resident who has lived in Canada for the previous 18 months, and who has a valid permit in the 19th month other than one that states "does not confer status" or "does not confer temporary resident status"
    • an individual who is registered, or entitled to be registered under the Indian Act

You need an approved LMIA first and then get an approved work permit. Then you need to meet bullet 4.

supervisa is a form of visitor visa, I don't believe you can get CCB on visitor visa.
May be. But it's unusal to get a work permit while on supervisa. Are you able to get LMIA?

I know while on visitor visa i can not get CCB, but my question is suppose I completed 15 months as visitor visa and then I get LMIA work permit , can I get CCB after 3 months(total 18 months)

You will have to contact CRA, but you must also have been a tax resident. Are you filing taxes in Canada?

You would start from scratch and have yo complete the 18 months first. Your biggest obstacle is getting the LMIA and WP or getting future study permit extensions if you are needing CCB to afford schooling. Your child is attending 8th grade. Supervisa weren’t set-up for grandparents to visit Canada while their children are international students especially if not post-secondary education. Under a supervisa the child who sponsored you should be providing your living expenses and if you want your child to study in Canada as an international student you will need to show that you have substantial savings since there is zero guarantee of getting PGP and PR before he finishes high school or university. If you are struggling with funds while he is in grade 8 it would make much more sense to return home and save your money. Paying for university fees should be prioritized over high school unless you have substantial funds and can pay for all his studies.

You have to work for 18 months before you qualify for CCB. You can‘t use your time visiting towards the wait time to qualify for CCB on a WP. You’ll need to get a WP and likely an LMIA first and then after you start working it will take 18 months to qualify for CCB. The parents on a supervisa are likely at a mature age where it will be more difficult to be considered as a longterm worker especially given they have a child who is an international student studying in grade 8. There will be concerns that the family may be trying to secure WP only to access free public education and they are not a true temporary worker with strong ties to their home country. Definitely worth trying but there are quite a few obstacles.

Please does anyone knows if Canada Child Benefit is considered social assistance? as I have sponsored my child for PR and it says there's a liability for 10 years to not claim any social assistance from the govt. And if that happens the sponsor needs to pay back the social assistance amount. I would not want to apply for it if child care benefit is considered as social assistance.

Please guide.
