Hello there,
My brother is a Canadian Citizen and he is living in Hong Kong now. My sis in law is a New Zealand Citizen and they will be having their first baby in Nov.
IN this case, does the baby gain the Canadian Citizen automatically? What they have to do in order to get their baby become Canadian Citizen?
Also, my brother also would like my sis in law to be Canadian too.
If they apply for the immigaration, can they apply overseas? And how many years do they need to stay in Canada in order to get the CAN citizenship?

Please advise. Much Thanks!

Pre-Assessed..
The baby will automatically be 'Canadian'
The spouse wil have to go through the sponsorship (spousal) process in order to get the PR + Spend 3 years in Canada and then apply for Citizenship.
Not sure if the application can be filed from overseas; you will have to refer to the CIC website and/or other forum members replies.

Good Luck1

Not automatic. The father must have been either born in Canada or a naturalized Canadian for the child to be Canadian. If the father was born outside of Canada to Canadian parents, the child isn't Canadian and would need to be sponsored along with the mother.

See what I wrote above. If the child is Canadian, he would need to apply for the child's Certificate of Citizenship.

He can sponsor his wife for Permanent Residency while living outside of Canada but he would need to show that he intends to return to Canada permanently in order for the app to be approved.

Citizenship currently requires 3 years out of the previous 4 in Canada, though that will most likely change to 4 years out of the previous 6 when the new citizenship bill is approved.
