hello,
I have couple of question regarding the Child Benefit and Maternity Leave. We are currently PR of Canada and right now my wife is in visit in USA. She is around 7 month of Pregnant and planning to have baby in US. If we have baby in USA.
1) Does we get National Child Benefit when we come back to Canada, as the child will be US citizen.
2) Is that any way we can apply PR for our child as the child will be living with us in Canada.
3) Will my wife get Maternity Leave Benefit as she had worked enough hours required in Canada?

According to Canada Revenue Agency gide lines, to be eligible for CCTB, you must meet all the following conditions:

you must live with the child, and the child must be under the age of 18;
you must be primarily responsible for the care and upbringing of the child;
you must be a resident of Canada; and
you or your spouse or common-law partner must be a Canadian citizen, a permanent resident, a protected person, or a temporary resident who has lived in Canada for the previous 18 months, and who has a valid permit in the 19th month
.

You can sponsor your child to get Canadian PR after you arrive in Canada.

Your wife will qualify for benefits with her employer - if she has short term disability, that's usually what pays maternity leave in the USA. She would need to check with her employer to see what she is allowed. Just a head's up, the USA is well known for having poor maternity benefits.

I don't believe she would be eligible to recieve EI in Canada for maternity leave based on their website: http://www.servicecanada.gc.ca/eng/ei/types/maternity_parental.shtml#eligible

You may be eligible to receive EI maternity or parental benefits if:
you have paid EI premiums;
•you meet the specific criteria for receiving EI maternity or parental benefits;
•your normal weekly earnings are reduced by more than 40%; and
•you have accumulated at least 600 hours of insurable employment during the qualifying period or, if you are a self-employed fisher, you have earned enough money during the qualifying period.

The line I put in bold alone makes your wife ineligible to get EI.

In order to get your children into Canada, you'll need to apply for a temporary resident permit (not a TRV, a TRP). Search that term on the forum for a good explanation by one of the senior members because it's complicated.
 
Being a U.S. Citizen your child could be allowed to remain in Canada without a temporary resident visa up to 6 months. At the port of entry you should request for an extended visitor record for your child. It is at the discretion of the BSA, but when you explain that your are going to sponsor the child as soon as you arrive in Canada, you may be able to obtain a visitor record, valid for a year or more. In such case your child has been granted entry to Canada as a visitor for that period of time.

For sponsoring the child for Canadian PR, the father or mother of the child should be in Canada and submit the sponsorship application to CPC Mississauga. Upon approval of the sponsorship, the PR application should be filed outside Canada for visa processing. Please be noted that you cannot sponsor your child when you and your wife are in USA. If you are entering together with your wife and child to Canada, you should get an extended period of stay for your child in Canada till the PR application is granted, which could perhaps take up to one year or more.

I do not know about Canadian Laws and regulations, but I know 100% that your child will aquire U.S. Citizinship here in U.S. even if you came illigaly in U.S..
Someone mentioned before you child would be ablte to go with you back to Canada without any visas for 6 months because he/she is U.S. citizen-that is correct. Keep in mind that you have to get a birth certificate first and then passport in U.S. for your newborn. Usually it takes anywhere between 10 days to 14 days in order to get birth certificate and then you can apply for passport which will take another 4-6 weeks from the moment you apply.

I am confused with this condition. For example, if a family with PR visa come to Canada with kids, stay for 6 months, received the child benefits for 6 months and need to go back to the original country after 6 months. In this case, do they need to refund the child benefit they received for this 6 months?

I am a Canadian citizen and my wife is a PR. My wife is pregnant. I live in Niagara and work in USA. I was wondering if I have to live in USA in order to get baby born in USA? or I can stay in Canada and go to USA some time before baby is due?
