Charged outside canada without conviction

Hi There,

I was charged with Assault of act of indecency outside of canada, I did not get a conviction, they gave me a 2 year bond good behavior without conviction, Can i apply for a spouse visa after the 2 years bond? or Do i have to wait 5 years to be deemed rehabilitated?

You will have to apply for rehabilitation. Deemed rehabilitation does not apply for serious criminality and assault is considered serious criminality in Canada.

You cannot apply for rehabilitation till five years have passed from the date of the completion of the sentence (in your case the 2-year bond). So you have to wait for seven years from the date you committed the act.

Criminal rehabilitation is complex and you should consult a lawyer with experience in these matters to get more specific advice.
