Change my dependent visa to independent Student Visa After Divorce

Hi all,

Please help me with this. I am right now on Dependent or spouse open work permit and I have been accepted in UBC as a graduate student with scholarship. Now the problem is my Husband wants divorce and he said that I will have to go back to India to apply for student visa. Because I will not be able to go out of the country for internship or something as my Visa will get Void after divorce or I will not be able to re-enter Canada once I leave it on the basis of my study permit. I should have a student VISA. Is it so? I can't go to US for a day and change my status on arrival? Or How much time does it take to get visa if I have a valid study permit and I apply for VISA from outside canada. Please need an experts help. As it is a very important matter. I don't want any trouble after Divorce.

I am sorry to hear it. If you have a valid visa, you can apply a study permit within Canada. Try for it.

1. No, once you have a study permit in your own name, then what your spouse does is no concern to CIC, as long as you can afford the cost of the studies and living expenses.
2. Once you have the study permit, you can apply in Canada for a new TRV (if your present one is no longer valid)

one more problem is that my passport bears his name and I got admission on his name only. So I will get study permit on his name. So will this thing interfere with my visa after divorce?

Your study permit is given to you . Your dependent visa was given because you were dependent on your husband. You are no longer dependent on any body for your study permit. You will get a permit on YOUR name, not anybody else's
