Hey Friends ...please someone help me or suggest anything?! I read all Canadian regulations and called the CIC office but couldn't get a clear answer about this... If i am paid from a company (from outside Canada)by two thirds of pay and one third from Canada for a job that is otherwise fits the CEC regulations , would i be eligible??

Thanks

interesting situation....I think they have not defined the canadian employer anywhere in the regulations or operational manual relating to CEC, the only condition is that the experience is acquired in Canada, thats it......but in a regulations pertaining to citizenship applications they define Canadian employer as one who is established under Canadian acts and regulations and has an ongoing operations in Canada, so my two cents are to be on the safe side provide an explanation letter from the employer mentioning their canadian registration tax number etc .If I could present such documents then I would not worry about it any further.

Best of luck!

Thank you both
I work in Ontario in a big hospital as a resident doctor, i have work permit and 18 month experience, as well as ielts with 7 in each category. Also i work 40 hours a week. The problem is that i have a sponsorship from a university outside canada and the pay me nearly 2000 a month and the hospital here only pays 1000. I had my T4 slips with the 1000 on them and declared the other 2000 as global income for me and it will appear on my Notice of assessment. I couldn't find any similar case like me. I read hundreds of regulations and data , but nothing really helped. I have a refrence letter from the hospital and it says i am being paid from both places so that my total payment is the same as any othe resident doctors at that hospital... Ahhh

are you working on work permit or PGWP? sounds to me that you are working on some kind of mutual agreement between two hospitals so you might not be able to apply if there is a condition that you have to return after serving the due agreement/contract

No i am on a work permit no PGWP, i have a job contract with the university in my country, they pay me here so i will go back, but i want to go back, the hospital here does have any relation to this agreement, except for that they want you to have some kind of scholarship to get the Job. I am not in any Canadian Governmental exchange pragrams.

@maza: I think you can apply as your number of Hrs criteria is still fulfilled. I hope that is written clearly in your employment letter.

As far as salary is concerned, you can provide an explanation letter(with supporting docs like T4, salary slips etc).

I would have applied like that in your scenario. Worst case would be to loose 500 CAD.

Thank you Godzilla...

I am keen really on getting a permanent residency , i have t4 only showing 1000 and i added the rest to the NOA... my employer will write me a letter saying i have sponsorship for a part of my internal medicine residency training and that the hospital pays me the rest of my income so my total would be 40000 a year... and he wrote i work for a total of 50 hours a week in addition for my on call duties?! hopefully this would work for me... I am searching for a good lawyer opinion on this too

Thank you...

It does have all these included.... my employer is so helpful and cooperative... and also these are really my duties as per the contract...

i just read this online

(f) any period of study or training during which the foreign national was a recipient of a Government of Canada scholarship or bursary, or participated in an exchange program sponsored by the Government of Canada, a purpose or condition of which was that the foreign national return to their country of origin or nationality on completion of their studies or training shall not be included in calculating the period of full-time study or training;

I am not receiving any canadian scholarship and i am not participating in any exchange program,,, but my scholarship from my university back home has a condition that i have to return to work with them if they agree on sponsoring me ??? What do you Think???

THANK YOU

You mentioned that you are in internal medicine residency, however NOC 3111 only includes surgical resident. even though your job duties may be similar to what described in NOC 3111, but your letter states your title differently, which may cause confusion. Also CIC states that "It is also important to note that work experience you may have acquired as part of your academic program, such as an internship or a co-op placement, does not qualify under the CEC". you may need to be careful that you are still in your residency training towards your practice permit, even though you are paid, it may not count as work experiences. I am not 100% sure, but you better consult a good lawyer
