I hold a work permit as a food counter attendant when i first came her in canada last july 2012. Two months after i had been promoted to Assistant Manager. If i plan to apply under CEC which will be after i comply the 12 months requirement what do i have to do to prove that i fall under the skill type job even if my work permits says otherwise? What do i need to asked for my employer? Or if my employer can't provide any us there a way or me to prove it?

Thanks.. Hope you guys can help me to prepare for my future application..

Ansku, it sounds like your work permit is for the lower skilled occupation stream, is that correct (Skill level C/D)?

If so, your promotion constitutes a change in employment, to a skilled occupation, for which there was no authorization.

Your employer didn't do you any favors. If you claim skilled employment, you reveal it was unauthorized, and don't qualify under CEC. If you claim unskilled, you don't qualify under CEC.

Of course, your employer could try to get an LMO for your assistant manager position, and you'd have to obtain a new work permit and then work another year to qualify for CEC. Otherwise I suggest you look into the provincial nomination program for your province:

You might want to talk to an immigration lawyer.
