CEC - PR Application for spousal open work permit

Hi,

I came to Canada in mid of 2022 on closed work permit and working as software engineer. My spouse accompanied me on open work permit. Now she is about to complete 1 year work in Canada. So i have below queries,
1. Can she become primary applicant in PR application?
2. Is she eligible for Canadian Experience Class post completing 1 year of full time work experience?
3. Can she get additional points by showing the job offer from same employer currently associated with?

Hey, to answer your questions.
1 & 2: She would be eligible for CEC depending on the NOC level of the job she has the 1year experience. NOC O, A and B are required for CEC.
3: She can not get additional points for the job unless there is an LMIA.

Question: why is she applying and not you as the primary applicant?

We both are planning to apply separately. This means, she will be primary applicant for one and I will be primary applicant for other application. So that we both have higher probability to receive an ITA. However, my spouse has an age advantage.

Can I ask you one more doubt? - My wife is currently working as Early Childhood Educator Assistant. She got this opportunity because of OPW. Is this job aligned with LMIA? If so, can she get benefit of job offer points?

LIMA is something the employer has to do. If she got the job on the OWP then it will need the LIMA if she is going to apply as the primary applicant. For the purpose of CEC getting LIMA is not required but if she wants the job offer points, LIMA is required.
