Cec , hours and lmo compliance....Any Advice ???

Hi guys, first of all thanks for this forum as it is a great resource and stress releiver haha.

Im 3 weeks away from filing my application and at this point im freaking out at almost anything.
My problem is as follows.
i have one year of employment and 2 month on a closed work permit what totals the hour requirements
for cec. But the issue is that i worked 27hrs per week at $24. But my lmo stated that i was supposed to work
37.5 hrs a week... can i get rejected for this even if i complied with the wages and other conditions
for my position.

I will apreciate any answer on this topic (please be polite and considerate while answering)

well... that's a really good question. Your employer would not have received an LMO for a part-time position, so you / your employer did not comply with the terms of the LMO. You haven't explained why, but I'm not sure how much that matters.

Unfortunately, you'll probably just have to apply and let us know.

Thanks for your reply. Is a small company so work slowed down and i ended up working less than expected.
but as you said that doesnt change the facts now. I been searching all over but i can't find anything that refers to hours worked only to people been underpaid.....

I would worry less about the terms of the LMO (it's your employer who's on the hook for compliance), just make sure you can document everything - it could look suspicious, as if (a) you weren't really paid $24 per hour so are claiming, or (b) you didn't work the 14 months (e.g. trying to hide a layoff or leave of absence), and are trying to fudge the hours to make it look like you met the 1 year work requirement. I mean, 27 is kind of an odd number. (If there's a way to game the system, VOs have seen it...) But if it's all legit, I wouldn't worry too much. Paystubs that show the number of hours worked and the rate would be just fine.

Hi Choc24,

there is nothing to worry about in terms of compliance with the LMO according to the weekly hours worked.
you should be fine as long as you can prove 12 months of full time work experiencei n a skilled position(at least 30 hours per a week) since you worked 27 hours then you would have to work over 12 months to accumulate the number of hours required to close the gap.
please note that any hours in excess of 30 per a week can not be used towards your full time employment.
please note that paid vacation can be used towards your experience.

Hi and thanks for the replies.
The odd number is cause i ended up working 120 hours per month so is not exactly 27 hours per week (i would have to do the math and document this right before applying).
I have all my pay stubs to prove it and my T4 so i think my only worry was about complying with the terms on the LMO.
Any of you have any experience with odd hours ? If so how did you guys work around it ?
