Hi,
We are in Canada for the last 2 Yrs. My husband is here on a Valid work permit. He works for a US company. They have sent us to Canada for a Project. So, our employer is a US employer and our client is a Canadian company.

I want to know if we can apply under the Canadian Experience Class. Does the condition specify that we need to have 2 Yrs of experience in Canada? Or 2 Yrs of work experience with a Canadian employer? Please clarify.

Are you being paid directly by the US employer or the Canadian client? If the US employer has a Canadian subsidiary that is paying you in Canadian dollars and you are paying Canadian taxes, then it would be eligible for CEC. If your husband is being paid directly by the US employer, that is not considered qualifying Canadian work experience.

Did your husband pay Canadian payroll taxes? EI, CPP, Federal Income tax?

I would say yes because the employer must have some sort of Canadian business registration (CRA number, employer number, etc.) to pay these taxes, therefore making them a Canadian business. I'm thinking subsidiary or master franchisor. Lot's of companies have these. Think KFC, McDonald's, WalMart, etc. Get a second opinion from an immigration consultant or immigration lawyer to be 100% sure that everything is in compliance.

I would say that it sounds like you could apply, but I suggest you look at the document checklist to be sure that you can supply all the required documents.

In particular, look at section 6, Work Experience.

You'll need copies of your Canadian tax documents, work permit, and a Letter of Employment from your employer in Canada. :) Can you get a letter from a company officer based in Canada? This may be the tricky part...

Hi,
I read thro' the document checklist. But the letter of employment doesnt specify that the employer should be canadian. I read that whole piece of information twice and i dint get to see "Canadian employer" in it. Have i missed it out?
