Please help.

I am qualified for CEC but my common law partner is shy of 8 month of work experience. She will be qualified after 8 month, just not now

My post graduation work permit is about to expiry so I can't wait for hers.

1. Can I apply as principle application and her as spouse? In IM0008 I'll be under Economic class and she'll be under family class?

2. How long does it take to receive AOR in this kind of situation ( apply with spouse)?

3. Can I apply just for myself and include a letter stating why she is not applying with me?

4. I've read something about applying for BOWP without AOR, how often does that usually succeed?

Thanks !!

No, but if you are common-law then she's your common-law partner and can be included in your application.

2. How long does it take to receive AOR in this kind of situation ( apply with spouse)?

Right now, people receive the AOR in as low as 17 days. As this is CIC, this is subject to change.

3. Can I apply just for myself and include a letter stating why she is not applying with me?

Include her in your application as your dependent.

4. I've read something about applying for BOWP without AOR, how often does that usually succeed?

You can apply by paper, instead of online, however, your AOR has to be issued before your BOWP application goes into process. I suggest, waiting for the AOR and the
filing the online BOWP application. Just to be on the safe side. If you act fast, 2 months SHOULD be enough time. No one will be able to guarantee that tho.

Thanks !!

Hope this helped.

Thanks so much for your quick response.

1. if I apply and include her as common law, we only need one IM0008 and I am the principle application and she'll be my CLP, right?

2. got it, thanks !

3. Sorry I don't quite get it...If I apply for myself and include her as dependent and she is not applying with me, it is allowed right? What if CIC asks me why she is not applying with me...

4. Hope I don't have to go through this...

thanks!!

sorry one more question, if we get married today and send the application together next Monday, would it be suspicious ?

which way do you recommend?

1. applying as common law
2. applying alone
3. getting married and applying right away

thanks!

Yes, please refer to >> http://www.cic.gc.ca/english/information/applications/guides/5609ETOC.asp
to see which forms have to be filled by you or by the both of you.

I don't get your question. You both want PR, you are eligible and she's not, simply include her in your applcation ( since your are common-law ) and get PR for both of you at the end of the process. Why would you want to exclude her from your application?

4. Hope I don't have to go through this...

thanks!!

See above.

3. since she'll be able to apply on her own within a few month, I thought maybe it'll be faster if we apply individually. I am afraid that my wp would expiry before getting AOR/BOWP... I guess I was wrong. thanks for the heads up.

Doesn't make a difference if you apply as a single applicant or with dependents.

Just to be crystal-clear, if you have been living together for at least 1 year, you are common-law spouses and you are REQUIRED to include your spouse on your application, as a co-applicant (but there is only one Principal Applicant, and only the principal applicant needs to meet the CEC program requirements). Getting legally married is not required, as far as CIC is concerned, you ARE spouses, just slightly different document requirements than for those legally married.

It's not clear at all why you wouldn't jump at the chance to submit a single application for the both of you! Other than some people despise being (incorrectly) labeled "dependent" : ) I prefer "co-applicant" myself.

thanks for your response.

In IMM0008, how do I add her as a co-applicant?
On page 1, Q#3, I put down 2
On page 3, dependent session, is that where I put in my CPL's info? -- or does she need her own IM0008? It is confusing cuz "please note that the generic application form for Canada is required for ONLY the principle applicant"

please correct me if I am wrong...
put my CLP on page 3 of IMM0008 as dependent even though she is considered as a co-applicant?

Thanks !!

Sorry - not sure why is this confusing? It means that only the principal applicant (you) fills out the form. THere are other forms that she will have to complete, however.

Yes. No functional difference between "dependent" and "co-applicant" as far as the CEC application process is concerned.
