I'm thinking of marrying in China , then file for sponsorship in China.

Then I read that foreign applications get more rejections. A foreign application has an appeal process, while a Cdn application has none from what I've read.

You don't have to stay in China but if you are living exclusively outside Canada at this point, you have to prove you plan on returning to Canada when your spouse gets PR. However, it doesn't sound like you are exclusively living in China if you have a job in Canada to get back to.

It doesn't matter where you are at the time you apply for sponsorship. You can not apply inland unless your spouse is in Canada when you apply. Then you have a choice of inland or outland. If your spouse is in China, only outland.

I do not think that more inland applications are approved than outland. Inland are also often denied or go to interview. If an inland goes to interview, your spouse would not get first stage approval until after the interview and in some local CIC offices, they are so busy that it takes 2-3 years to get that interview. In the meantime the spouse is not allowed to work and does not have health care. If you go to appeal with outland, at least it tends to be a bit faster than that although you would be apart.

I take it that CIC will look at the length of time we have known each other. I've heard that they like to see two years before we get married.

It's been 9 months and we'd like to get married. I want to live in Canada and then retire to China.

but it depends were your wife lives in china if in south it will be sent to H/K if in north to Beijing

I've just spent 4 hours reading posts and can't find what I want. I guess I'm not being really clear here?. I would rather bring my fiance here and just have her stay. I don't think she'd get a visa, she's just a nice simple woman who doesn't have much, no house, car etc. I doubt CIC'd let her in if they knew she had a fiance here. >>So I'm worried what time frame CIC wants to see from meeting to marriage???? The emails, phone calls, pictures I've got. I'm just worried that it looks like we're rushing and truthfully we are so that we can be together.

From what I'[ve read she wouldn't get a vistor visa because she doesn't have much money, no house, car. Then for her to come here and deny she has a BF, stay longer than she originally stated, then get married, have both of us lie about our relationship. I have mixed feeling about doing this, on one hand it's could be faster for us and who are we hurting? On the other hand I see a CIC interviewer saying the marriage is a fraud because we had no previous envolvement, we can't tell them that we lied.

You shouldn't lie about the relationship. At least say that she is coming to visit her boyfriend. Immigration doesn't like it much when you lie to them. So you can bend the truth a little bit but that is a bit different. Coming to visit boyfriend and ending up extending the stay, getting married and applying for sponsorship is a likely story. At least better than not mentioning boyfriend when visiting and suddenly getting married to some guy :)

If she stays in China, Hong Kong would process her application if I sponsor her outland and thats a 16 month wait,plus 44 days for sponsorship approval.Thats' way too long to be apart and trips to be together are expensive.
I'm finding the whole issue kind of a violation of human rights, a false marriage, a poor one, a good one, a bad one, shouldn't be anyone elses concern.

Arghh! I replied at length to you, but then somehow erased it before sending it. So this is my truncated version.

I understand your resentment that some bureaucrat is empowered to judge your relationship, but that is our world when we decide to espouse a Chinese woman!!

Without going into details, but based on my experience (I type with only two fingers, and cannot bear to repeat my previous typing), I don’t think your fiancee will be given a temporary visa to Canada (insufficient ties to China). So, you will have to apply for PR outland.

She lives in Guilin, so you might be lucky and be processed through Beijing (good news, because Beijing is faster than Hong Kong), but confirm which office handles Guilin in the CIC website.

No one knows whether waiting longer to marry will impress CIC, and if so how long you`d need to wait, so I`d just go ahead and marry, and if that prompts an interview, so be it.

How is her English, or your Chinese? CIC gets worried about large differences between two married people – figuring that the more differences there are (education, age, language, culture, wealth) the greater the chance that the marriage has ulterior purposes (for the visa, not for love). That is the CIC mindset, so bear this in mind when you submit your PR application. Try to show that the short courtship was for compelling reasons, and that you pursued her (not vice versa).

One final word … welcome to the underworld, Mate, the world of international bureaucracy. It is a labyrinth!!

Being refused a visa due to having a bf is not a given but she needs to be able to prove that she will not overstay in Canada. Having few assets in home country, no job or studies to come back to and a boyfriend in Canada are all factors that could get her denied.

It is also not a given that your outland will take 16 months in Hong Kong. As it says, 80% of the files have been processed by that time. The average is definitely faster and yours may even be faster than average.
