CBSA Officers very unprofessional

I was stopped by airport customs for not having proof of employment. The airport customs (CBSA) women were very childish, unprofessional, loud, untrained in handling people and indifferent to the impact their decisions was having on my situation. I understood that it was a mistake on my part for not understanding and/or knowing what the Canada requirement are with getting a Work Permit. But, I was totally disappointed that Canada put these kinds of unskilled people in this sensitive situation where it appears their ONLY training is to DENY entry and try as hard as they can to make Canadian look like total idiots in the process.

My question is: these CBSA knuckleheads kept talking to me about a 6 month exclusion where I had to promise not to return to Canada for six month, but I did not receive an IMM 1214B form. Was I suppose to get a signed copy.

Please advise to how long does it take to get an ARC?

Also, I have contacted and hired a Canadian lawyer to work this issue, but to also file a complaint against the CBSA women who their efforts were just totally unprofessional.

Immigration officials of any country tend to be like that, ever been to the USA, Saudi Arabia, the UAE?? I would say relatively speaking Canadian officials are very nice.

U.S officials have even been known to threaten people with arrest and physical harm, in Saudi Arabia if you get mouthy with an official you will get a severe beating no doubt.

Their job is not to be nice and friendly, they can't read your mind and know your true intentions. Their job is to make it difficult for people to stay in Canada who are not citizens or pr holders.

Just as well you have sought advice in this case.

Was a report provided to you indicating you were inadmissible to Canada followed by a removal order?

I doubt one was considering at present Canada does not have removal orders that prevent return for a period of 6 months. There are exclusion orders for a one year duration, exclusion orders for two year duration and deportation orders for lifetime duration (and conditional departure orders with no ban on return where conditions are met): each of the 3 duration orders require ARC where return is desired to be overcome in a period shorter than the duration of the order.

Were you allowed to withdraw your application to enter Canada? This results in no removal order, but would require you on a future application made to enter Canada at any time to satisfy an Officer that you are not seeking to enter Canada as a non genuine visitor, worker etc.

Perhaps further details of the exact situation could provide all with a clearer picture of your case,

Thank you so much for your response. Your response has really calmed me down.

Yes, I was given a form stating that I was not admissible into Canada for not having proof of employment, although I could of had it fax to them). I also signed a document stating that I was voluntary withdrawing my application for entrance into Canada. I was told to promise that I would not return to Canada for 6 months. I then was escorted to make flight arrangement and thru US custom to my departure gate. I was told because I had worked in the country, without a work permit, that I had to leave the country.

My finding is that most Canadian (Fortune 500) companies seem to have no clue as to whether a “Work Permit” is a necessary requirement to work one day in Canada on a long term duration. But I also recognized that ignorance is no excuse of the law.
But I still insist that these CBSA morons they having working the airport gates need to be trained to “the intent of the law” NOT the Letter of the law.

My Canadian Immigration lawyer reported to me this morning that the CBSA agency is difficult and slow with getting him the information that was put on my passport file.

Canadians can say what they want, but there IS a shortage of qualified craftsmen and professionals in Canada. Canada comes to the US everyday for help and offering big dollars to bring that help back to their country. The US also has a shortage of qualified craftsmen and professionals. Canada competes in the US labor market for this labor, but Canada seems willing to pay a higher wage to lure us to take the job, but its ironic to find when we get to Canada that this country is run by the idiots manning the entrance gates.

I personally do not care whether I get back in or not. I can stay right here in the US (with the same company) and make a good living. I don’t need Canada, but Canada does need me and others like me. Like they say, its Canada lost, not mine.

You just make me laugh, typical American way of thinking.

My family and I had to overcome several obstacles to finally immigrate here, but I am actually happy that it is that way because I don't want just anyone to immigrate here specially the ones that think that they deserve everything and not willing to do the right thing and/or to work hard to get it, Canada is worth the hassle.

Hahaha… from your blog name I can assume you’re from a third world country that Canada is trying to close their doors on. So, I can see why you would want to show much love for Canada. I too have much love and respect for Canada, their citizens and way of life. But unlike you, I came to Canada at my Canadian owned company’s request that has many offices in the US. I did not come to Canada to escape poverty, crime and political injustice and not the mention the non-existence wage scale of your home country. Besides, that the US and Canada share much trade across our borders (650 billions worth), unlike any place else in the world. So don’t view US citizens coming to Canada as nothing more than a brother/sister spat at the border. I am (blog) venting, at the lack of training that the CBSA border agent seem to lack.

I guess you can say a lot of things by just looking at a name, that is call profiling and it is related with racism; but you are wrong my country of origin has a big trade agreement with Canada and is not closing any doors soon; actually I am here thanks to that agreement.

Thanks again for your most helpful and correct advise. I am back in Canada now with a work permit and the CBSA customs agent were very helpful and nice. The first time I came though must of been when one of CBSA agents was having a bad day. Like I said, the Canadians and US American are brothers and sisters that will have their spats, but in the end are watching each others backs. I have many Canadian friends that live and work both in the US and Canada and we all share the same sentiments.

I do want to say this blog was most helpful with helping me understand and resolve my situation.
