Caregiver program

Hey!

So I have worked in Canada as a live-in nanny for 5 months last year and I am now back for 5 more months in the same family. I am here only as a visitor and I do not have any visa. I don't want to leave again and I was wondering if I could apply for a work visa. Can I list those 10 months working in Canada as experience to enter the caregiver program or would that disqualify me? I have to leave Canada in August. Would they ask me to leave right away if I apply and say that I have been working "illegally"?
I do not see myself living anywhere else and I am desperate to find a way to stay :(

If you are working in Canada as a visitor then you are engaged in illegal work and you are in violation of the condition of your visitor visa. No - of course you will not be able to count the 10 months of illegal work as work experience - it's illegal work and illegal work doesn't count. If you are discovered, you will be told to leave Canada and should expect your visitor visa to be canceled. You should then expect it will be next to impossible to qualify for a visitor visa or work permit.

Your employer needs to obtain an approved LMIA in order for you to be able to apply for a work permit. There's obviously no guarantee the work permit will be approved and you will need to meet the caregiver program requirements without counting your experience in Canada.

Unfortunately you've created a bad situation for yourself by engaging in illegal activities. If you are desperate to stay then you should stop working illegally immediately. The longer you work illegally the more potential problems you create for yourself and your future in Canada.

Yes if you lost you work permit as a Live in caregiver last year and you only have tourist visa, yes its illegal. If i were you ask your employer to get an LMIA and get a new work permit. I think you need to seek for a legal advice to an immigration lawyer.
