Can someone suggest me ..can't Spouse really apply for OWP from home country if main applicant in canada doesn't have the 6 months TRV but he does have the reason he will extend further in order to complete his studies.

Can someone suggest and share your experience.

No you cannot apply for visa unless your spouses visa is more than 6 months valid.

The trick here is it should be valid for more than 6 months, NOT the day you have applied for OWP-S but the day your application is getting approved by the Visa officer. So when your application is with Visa officer for decision, it should have validity more than 6 months. ideally the day you apply it should be around 8-10 months valid.

Your spouse needs to apply for extension of visa. Get a letter from CIC stating that her validity has been extended. Then only it is possible for you to apply and you will need to add this new letter with your application. You cannot apply on the basis that your spouses visa will extend.

Can you explain in my situation what should i do now?

Now my husband does have the visa till 31 mar'14 and further he will extend his visa in Jan'14 after get the letter from college and his study is till april'14.

So when would be the right time for me to apply for OWP because after Jan'14 he will get his visa for next 6 to 7 months but his studies is going to over in april'14.

So when should i apply ?
