"Can't find a Canadian to fill the role"... What exactly does this mean?

So, looking for employment in Canada...

I have everything set up - Canadian style Resume, contacts, agencies, LinkedIN with hiring managers, cousins over there speaking with their employers, looking all over Canada.

However, I am curious to understand how the employer will be able to hire me (LMO and all that). I keep reading they can get the LMO if they can't find a Canadian to fill the role... but what exactly does that mean?

If I apply to a job that a dozen Canadians apply for... say we are all on par in terms of 'fit', but the employer would prefer to hire me. Does that mean they can hire me?

I work as an IT Consultant more Non-technical (NOC 2171), more DC Migrations, Cloud Adoption Strategy, IT Transformation projects, Service Design, Processes etc.

I'm sure theres enough candidates any employer could hire that are Canadian... so how would they have to prove they couldn't... Can it NOT be based on preference?

This means that Canadians are obliged to take care of their unemployed workers first and, if can't find anyone to fill that position, than alow foreigners to enter Canada and work there. Basicaly, not very much different than any other social responsible country, they care about their citizens.
If the employer can prove that he can't find anyone in Canada with needed qualifications he is alowed to "import" someone from abroad.
The problem can be solved if the employer creates a position according to your qualifications (eg. demands knowledge of some exotic language) knowing that he wouldn't be able to find a worker in regular way.

I think that you will find that this is not permitted. Only one of the Official Languages can be mandated. With the new LMIA rules and scrutiny, there is almost NO chance of being able to do this sort of "selective hiring" any longer.

No, an employer can't hire a temporary foreign worker if there are Canadian applicants qualified to do the job.

Even if that foreign worker is 'better' qualified in terms of skills and years of experience?

I am trying to understand how this will all fit in with the Express Entry system in 2015. If, in order to have a job the employer has to go to great lengths to prove their is noone closely suitable, then surely the number of people being accepted as FSW next year will be very limited to perhaps just a handful of specialities.

I highly doubt there will be, for example, 1000 NOC 2171 positions when I am sure there is someone in Canada to do those jobs to some degree of suitability.

I doubt there is any incentive for employers to get involved next year.

I think you are raising genuine concern and perspective. Expression Of Interest (EOI) to be successful at all, there should be substantial supply of vacant jobs in the economy. I am not sure whether it is the case in Canada. Why? because Canadian employers are stuck with the much discriminatory notion of the "Canadian experience". Nowhere such a thing exist.

So for Express Entry 2015, does there need to be a firm job offer from an employer or just a supply of jobs in your field?

In order to get a job offer I assume there would be applications, interviews, 2nd round interviews etc. The type of work I do in NOC 2171 aren't just handed out.

On top of that, for NOC 2171 there are many skills that are quite easy to obtain to an 'adequate' level. So there may be many many locals able to do the minumum the job requires or be trained towards it. To truly test consultancy skills, there needs to be interviews.

If a firm job offer is required, then I believe the system will be very limited to perhaps a few fields which aren't easy to build skills in - doctors, nurses etc.

But I cannot see if it states a job offer is required or whether the employer just has to show 'interest' in you?

Any thoughts please...
