Hi,

I and my ex common law separated last 2015. We got our PR last Sept 2014, I brought our Son here in canada after we received our PR. Unfortunately, things didn't went as planned and last 2015 he decided to break up with me. As I am in a stressful health situation that time, I don't wanna argue with him again and again and decided to just deal to what he wanted. I agreed with the separation only on one condition, to just leave Canada so that we both can moved on. He asked me to let him stay until he gets paid all the debts he have. He left for Philippines to get his vacation for a month and after the vacation I just heard from common friends that he got married in Phils ( he re-married his ex wife ). Well, of course my heart was broken but have to be strong for our son and I have to think of myself as I am not in well condition that time ( I am pregnant ). I asked him to leave our house as we are still in one house even after the break up. I just asked him to give a financial support to our 11yrs old son and give a time to see our son and obliged him to some doctor's appointment and activities that our son has. But, a couple of months ago I heard that he has a girlfriend here in his workplace and that gives my son an emotional torture of not being seen by his Dad more oftentimes and just having a small time to spent with him. I am not sure of whatever reason he has but what I am sure is that we are emotionally stress of what he is showing us. I already moved on, but I don't want this repeat arguments with him over the phone everytime he fails to come on time, give more time to our son and do such mess in our lives. I wanna asked if I could ask the CIC to cancel his PR and just go back in the Philippines, to his wife and son there? What should I do?

Hi

You can't do anything to his status. I suggest you seek help from a family law lawyer regarding your issues with your ex.

You can't tell IRCC to do anything. There doesn't seem to be any conditions that would still apply and allow reporting him. His PR is his own and you don't have any influence over it.

What others have said. You have no right to cancel his PR status - it's his to keep legally.

Hi,
thanks all who replied. Wanna ask if I can't ask cic to cancel it even I am his sponsor? are we not under the condition of pr of staying for 2 yrs once we get the pr? is it not included of his being lied to me regarding his remarrying his ex wife?

You're not his sponsor. You immigrated to Canada with him as part of the same application. You were just the primary applicant (this is not the same as being a sponsor). Being a primary applicant does not give you the right to cancel his PR status. Again, it's his to keep.

No - the 2 year condition does not apply to you.

You would only be his sponsor if you were Canadian and had sponsored him for PR as your spouse through the Family Sponsorship program.

Once again, his PR status is his to keep. You need to move on - nothing you can do about it.
