Currently we are in a common law relationship but we have been living in the UK with my partners parents due to financial reasons, would this be a problem when applying?

We both pay rent and we will draft up a contract between us and his parents which will be signed by a notary public.

Setting up a contract is a good idea as this will help solidify your CL status and i've seen many common law couples apply who had stayed with parents. You will need to show evidence that the sponsor will move back to Canada when PR is granted, so having a plan on how you will support youselves in terms of accommodation, jobs and finances is beneficial.
