Hi I have a unique situation (maybe not) and as my name suggests I am totally confused with the laws but I am hoping that this forum will help me with my issue :). The situation is that I am a canadian permanent resident currently living and working on H1 in USA. I am planning to move to BC Canada in few months. I recently got married and my wife is planning to come to US on a H4. I am going to file her residency for canada as soon as I make my move to canada. My question is, can she live in USA on a H4 without any issues till her residency is under process when i ll be living in Canada? Also as I work in USA and will be commuting from canada for work and also to meet her, there wont be any issue in crossing the border? Thanks in advance. :)

I think you should ask these questions on a US immigration forum. From what I can see your two questions are:

1) Can your wife continue living in the US on an H4 when you are no longer living there.

2) Can you continue to use your H1 to enter the US even though you are now working in Canada.

Both of these questions involve US immigration law and would be better asked on a US immigration forum.

Thanks for the quick response, I will ask these questions in US forum as well. Just wanted to clarify that I wont be working in Canada but in USA. I will just move to BC Canada but I will still be working in USA and will be commuting to US on a valid H1B. Thanks again.
