Canadian PR

I become Canadian PR on July 16th 2010 and hardly lived in Canada for 15 days. I have understanding if I don't live in Canada more than 730 days my PR status get expire and that way my PR should have been get inactive in July 2013, but before this date itself I got job with Canadian company as full time employee and they allowed me to work from USA only.

If I go with option no 2. Employment outside Canada on CIC website It very clearly says that You will get counted each day you were employed outside Canada.

I'm currently getting salary in Canada and paying taxes at source, Now I'm going to file tax return in Canada so have few associated questions.

1. First Critical question, Is my Canadian PR is active or there could be some challenges at time of renewal?

2. Should I file my return as single or Joint return with my husband to keep his PR active too?

3. My Husband is earning in USA, do we need to file taxes on foreign income in Canada too?

4. My paystub has Canadian address, Is this O.K. for PR renewal in future?

Thanks in advance !

Hi there,
If I am not mistaken I think you have misunderstood that 730 requirement.
You need to be in Canada for 2 years out of the 5 since becoming a PR. So if you don't come back soon. You may loose your PR in July 2015.
And will have a hard time renewing it.

However in your situation you can also go with option 2.

You can then be the PR that he is accompanying outside Canada that is employed by a Canadian company.
As long as you meet residency requirements.

You need to file it together.

Were you hired by the Canadian company for a position in Canada first? And then after working in Canada for a while, did the company transfer you to a permanent role to an office they have in the US? If this is not what happened, then there's a good chance your time spent working for this company int he US can't be counted towards your residency requirement.

Is your spouse a Canadian PR or citizen?

Thanks for reading my post and replying same.

I was hired by Canadian Company to work in Canada only and later they allowed me to work from home(USA).My taxes are still being deducted by employer in Canada and my salary is being deposited in Canada only.

would you recommend any good attorney to take some legal advise?

I don't have any recommendations - but you should definitely speak with a good lawyer.

To count the days outside of Canada, your company must have transferred you to a role and office located outside of Canada. This isn't what has happened to you and I don't think CIC will let you count this time towards PR.
