Hello,

I am in a wierd situation...I am a landed immigrant to Canada in 2006 originaaly from India. but currently me(TD visa) n my husband are in USA on TN visa and now my PR card has expired. My husbands visa renewal is approaching soon. Hence i want to know

i. is there any way to apply for PR card from USA? or I have to be in canada personally for 3 months or so until I receive PR card.
ii. what will happen to my visa status if my PR card is expired at the time of my husbands visa renewal i.e., what visa will i be on, if i have to stay in USA?

I am really confused if somebody can answer my questions would really appreciate.

Thanks

Question: Can you get TN visa even when you are in PR status?

Has only your PR expired? What about your husband's?
When did it expire?

You should apply for your PR at the earliest to be in status. Else it will be illegal stay in USA.

Did you complete your PR obligation of 2 years presence in Canada during the 5 year period?. If you landed even at the end of 2006,your PR card might have expired already.

Hello Wilson,

I appreciate your response.

Yes i have stayed in Canada for 3 yrs i.e., 2006-2009. I am also eligible to apply for Citizenship and I am planning to do so once i get my PR card renewed. My husbands TN visa renewal is due next May 2013. Hence i don't want to apply for citizenship during this time while my PR card has expired.

@ Alias : My husband is on TN visa and he is a Canadian citizen. I am on dependant visa..

Thanks.

You are welcome. You should physically present in Canada for renewing your PR.

When you say "You should physically present in Canada for renewing your PR", do you mean i have to be there the whole time i.e., submit my application and stay there for 3 months or so until i receive my new PR card???
