Hello guys,

Hoping to find some advice or suggestion in our situation.

I'm a US citizen married to Canadian Citizen. Before we got married we had to make a decision between USA and Canada. Due to my husband's business, we decided to be in Canada. So i came to Canada in May 2014 (as a visitor), we got married and applied for permanent residency within Canada (INLAND). IT was the biggest mistake to apply inland!!! The processing time for canada inland spouse sponsorship is constantly increasing and now it is 25MONTHS!!!! (no work, no travel, no health insurance)!!! It's ridiculous and very frustrating. We started to think if we made the right decision regarding being in Canada and may be we would be better off in USA. I personally miss USA tons.

Now, I'm trying to figure out if we can we move to USA. I was trying to find any information, but the more i read the more i get confused. called US embassy in canada and all the said is to read online...is it the conflict of interest to apply for PR in Canada and USA? is it possible to apply for green card while in Canada? Please help me understand!

Did anyone had this dilemma?

Any advise is highly appreciated!!!

For the USA process, Once you file your I 130 form and then I 485, your spouse will be issued an EAD ( Employment Authorization Document) which will allow him/her to take up employment or own a business.

It is however important to prove that your primary residence as a sponsor is the USA.

I think Canada is also embarking on a pilot project to give work permits to spousal immigration applications.

It is fairly new, so look out for it.
 
If you leave for the USA before your inland sponsorship is done, you are abandoning your inland sponsorship. And if you do so and decide to have your husband sponsor you outland while you live in the USA and he is applying for a US green card, CIC will not believe that you have any intention of moving to Canada otherwise why would your husband apply for residency in another country?
 
Thank you guys for your responses. What we were thinking, is to apply for USA immigrant spouse visa, while waiting for canadian permanent residency. If USA visa is issued before Canadian pr we would go to USA and withdraw my canadian PR application.

I know before there was DCF (Direct Consular Filing), meaning if us citizen lives outside of usa he/she can file for immigrant visa for spouse directly to usa embassy in that country (in my case Canada). They stopped that program, and now DCF can be filed to Chicago. USA citizen still have to prove domicile in USA ( or intension to go back to usa).

is anyone familiar with this process?
