Canadian marrying an illegal

I.m a Canadian citizen my boyfriend is been living in the U.S. for more than 10 years with no legal status he is from Mexico we are planing to get marry and live in Canada what option do I have to marry him and sponsor him after should I get marry in the U.S. or in Canada.

Not entirely sure, but Him being illegal in US, will cause issues for Him in here as well. If one has spent more than 6 months in a country other than their homeland, they will need Police Certificate from that country. In this case, our brothers down from 48. parallel, he would need to send a set of fingerprints (say from RCMP, ~68 bucks) to West Virginia FBI Headquarters for criminality checks. Now he is not a person of status in there, so that poses a problem.

We live in America, where everyone is out for their own gain, there is nothing personal in this, it is just a business.

Now it might seem silly, but why don't you 2 lovebirds go to Mexico, marry there and then do the outland process, there is no way around it anyways. Just be brutally honest with CIC and you guys just might make it, God Bless.

You will have to get married in the US. He won't be allowed into Canada to get married. Once you're married, you will have to sponsor him for PR using the outland method while he remains in the US. He will need a valid passport to apply. Also note that once PR is approved and he leaves for Canada, he will be banned from re-entering the US for 10 years. So he should make sure he's ready to leave the US and not return for a decade.

No! If he leaves for Mexico to get married he won't be able to return back as he will be barred for 10years from reentering the U.S.A due to his overstay. You can apply Outland but just be aware that if an interview is required he will need to fly to Mexico and do his interview there. Once he does that he will no longer be able to reenter the States.
For inland, he will have to be able to come to Canada and then you will have to sponsor him from within here. He will not be able to leave until the process is done. However, him entering into Canada with his past immigration history might be difficult as he has a higher chance of being turned away. If he is turned away, he'll have to go back to Mexico.

My husband and I went through the same thing. If you would like to PM me you may and we can discuss. We got married in the U.S by the way. :)

As for the PCC, you would have to submit to the FBI which are not linked to ICE. My husband and many others did it and he was fine. No immigration history appears. There is NO problem sending your prints to the FBI. They are not connected like the RCMP here. In other words, they won't deport your significant other for applying for a PCC.

Well, Las Vegas it is then. I guess would be harder to find direct flights from Mexico as well, as many route through US, for time to come and land as PR. Good to know that FBI and Immigration are separate, until Mr. Donald comes around and changes it lol.

Well, Las Vegas it is then. I guess would be harder to find direct flights from Mexico as well, as many route through US, for time to come and land as PR. Good to know that FBI and Immigration are separate, until Mr. Donald comes around and changes it lol.
Theres tons of direct flights from Canada to Mexico and vice versa! :) One almost everyday to and from both Cancun and Mexico City...At least to/from Toronto.

LOL about the Donald comment...you never know with him. Anything is definitely possible!
