I'm trying to help my mother get this problem sorted out:

My mother is trying to come back to Canada after leaving in 1997 to the U.S. She met my stepfather in the U.S. when she was a permanent resident and he had valid work authorization in 1998. My mom lived in Canada from 1984 until 1997 and is a Canadian Citizen. In 2003 she gained American Citizenship. She owns three businesses and bought a home in the U.S. My stepfather had a DUI and had it fixed, went to court, was discharged, did his community service. However, he was rejected for his work authorization renewal. He was deported. He was rejected for re-entry into the U.S. Now my mother wants to move back to Canada with my half-brothers and bring my stepfather along. We are unsure as to how this will work.

My mother just received her Canadian passport last week, so she's trying to figure out what is next to do. She does not reside in Canada, but she earns enough to rent here without working and has over half a million in her savings. she has her old sin card, citizenship card, and the old red and white healthcard from ontario.

We don't know what forms to fill out for this situation and how long it would take. My half-brothers should qualify for canadian citizenship. My mom had them when she was a canadian citizen.

Your mother will have to talk to a Canadian embassy in the US about applying for citizenship certificates for your half brothers. Once she applies for them, she can apply for temporary Canadian passports for them.

As for the step father, she would have to sponsor him for Canadian PR. If he has a criminal record, DUI's etc., it could get slightly more complicated but if he only got community service, it doesn't sound like it was too serious.

She can start sponsorship of him before she moves to Canada but she would have to show that they are planning on moving to Canada when he gets his PR.
