Canadian and Pakistani spouse living in the UK?

Hello,
I am a Canadian female currently living in the UK on a Youth Mobility Visa. This visa will last for 2 years. I married my husband who lives in the UK, 2 months ago. ;D He holds a Pakistani passport, he was on a student visa for 4 years but it has now expired. Before it expired, he applied for a business visa, which was denied. He filed an appeal for them to reconsider his application in April 2014 and is still awaiting a response. My questions are: If I want to apply for a Canadian spousal visa, can I apply from the UK or do I have to go back to Canada? If I go back to Canada, can I work part time (since I am a student in Canada), or do I have to work full time in order to apply? Is no work fine too? There is a Pakistani embassy(UK VISA OFFICE) in London, UK, can his application be considered there despite the fact that his passport is in the possession of UKVI (UK visas and immigration) or do we have to send it to Islamabad, Pakistan? Do we need his passport in order to apply? Thank you so much for your help in advance.

Since you are a Canadian citizen, you can sponsor your husband from the UK. You do need to convince CIC that you and your husband will move to Canada once his application is finished. So you need to present a clear plan on your move back to Canada and how you and you husband will make a living. If you do move back to Canada, you don't need to be working, but you cannot go on welfare. And CIC may ask how you plan on supporting yourself and your husband when he arrives.

For his application to be sent to London, he would need to currently have resident status there. If his status has expired, most likely his application will be sent to Islamabad. And yes he needs a passport to apply but he just needs to send in a copy of it until he is asked to submit it when they are ready to give him his visa (I'm not sure where in the process Islamabad VO will ask for it however. Most of the time it is towards the end).

I need to correct myself. Looking at the country specific guidelines, Pakistani nationals need to provide a certified copy. He will not be able to certify the copy without his original passport also.
