CANADA WP REJECTED WITH REASON - URGENT HELP NEEDED

Last week one of my colleagues CANADA WP was rejected with the below reason.

You have demonstrated tht you come within exceptions under section 186 of regulations exempting you from requirement to obtain a work permit or tht ur employment in canada comes within the exceptions to section 203 of regulations. as a result your offer of employment must be the subject of an economic effect determination before a work permit can be issued to you. your employer in canada should contact local office of department of HR


I will be applying for CANADA WP next week. I just want to make sure i dont make the same mistake that was done in my colleagues case.

I am currently working in the India location of my company and i am just moving as intra company transfer and working out of CANADA location for the same company where I am currently employed.

My company will be submitting my WP; they have already collected all the documents from me.

Can someone please help me understand the above reason for rejection and what i should be doing different/additonal when my company files my CANADA WP.

You have to meet the following criteria to qualify for an intracompany transfer:

If you don't meet the above criteria, then you need an LMO to qualify for the work permit. It sounds like your colleague was refused because CIC didn't believe he met the requirements.

It is up to you and your company to prove that you qualify.
