Hello.
We received news today from the company`s lawyer where my girlfriend works, saying that my girlfriend`s work permit application was rejected. The reason, invalid passport.

To clarify things, we both are from Venezuela. Currently is near to impossible to get a new passport, so the Venezuelan government is issuing "extensions", which prolongs the validity of the passport for 2 extra years.

Until today, she was still working with an implied status while the work permit application was being processed.

As far as we know, this extension is a valid document and its accepted for immigration purposes, so we dont quite understand why it got denied. She has a LMIA and she has been working in Canada for a year, living here for 2 years too. On the other hand, she is my common law partner; I have a work permit valid through next year and I understand she might get an open work permit through me, we have done it before.

To highlight some key issues, but we might be wrong:

-she cannot apply within Canada anymore because she does not have a valid status, having been denied the work permit.

-she can appeal, but we are not familiar with the process, and we are not sure if the response will be the same.

-the other option is leaving the country and applying from our home country. This is something we want to avoid, for it takes more than 10 weeks and in general, is not safe.

-we are trying to contact an immigration lawyer too.

-we don`t know the specifics yet, but I believe she would need to leave the country in 2 weeks or so.

Can anyone please help us to decide or give us advice on what to do?
