Folks,

I'm looking for some advice/comments regarding my situation with regard to my PR application for Canada. I have been working in the U.S on a valid H1B.

I started the process of applying for a Canadian PR under the Federal Skilled Worker category in early 2010. In May 2010 I received an email from JCM, Service Delivery Agent, Citizenship and Immigration, Federal Skilled Worker Centralized Intake Office, Sydney, Nova Scotia, saying "your application is being recommended to the visa office for a final determination of eligibility for processing". Subsequently, I sent in all other documents that were asked for.

In Aug 2011 I received an email communication from Canadian Consulate General in Buffalo, New York that my file was transfered to them from Nova Scotia and a new file number is being alloted.

In Nov 2011 I received another email from the Canadian Consulate Generale in New York saying "Your file has now been transferred to our office for the assessment and processing of your application."

In Dec 2011 I received an email requesting for my educational transcripts (I have a master's degree from India) and FBI clearance certificates + Police clearance certificates from India. All of this information was mailed to them in the last week of Jan 2012.

In March 2012 I received another email asking me to get the medical examinations done. This was done at the doctors prescribed/authorized/listed by the CIC council, the results of which were couriered directly to them in the last week of March 2012. In the letter it said "if you complied with all instructions and undertaken all steps, allow 90 days before requesting status of your application."

As of today, it has been over 180 days and I have not heard any further update. I emailed them through their website and got an automated response saying "Due to volume of applications, we will only respond to request for application status if processing period posted on our website has been exceeded." As per their website, processing time for applications received after Apr 2008 is 30 months. If I were to consider that, I still have about two months more to expect a response. However, as per the last communication received from them in March 2012, they said I could check about the status of my application after 90 days from sending in the medicals.

One more interesting fact is that a colleague of mine, who applied about 6 months after me, got his PR in Jan 2012. He has already visited Canada and completed the landing process.

My question:

1. Typically how long does it take to get a decision after submitting the medical exam reports?
2. Are there any specific factors that weigh in making a (quick) decision with regard to an application ?

Generally they make a final decision within 4-6 months of completion of your medicals. Does your e-cas status indicate "medicals have been received"?

At this point, you might wish to order a copy of your file notes. They must be ordered by someone in Canada on your behalf and CIC charges $5 for this type of request (an "access to information" request) and you must provide written permission for them to release information about your file. See the link here for information about this: http://www.cic.gc.ca/english/department/atip/index.asp

If you do not have someone within Canada who can order these notes for you, there are commercial services that do this (for a fee, in addition to the CIC charge). One which I have used in the past successfully is http://www.caips.ca. You can sign and scan everything and send it to her via e-mail and she then in turn submits it to CIC for processing. Approximately 30 days after CIC receives the request you will get a copy of your case notes.

The notes they send you will be approximately 30 days old, but they will tell you the status of your file. It will show if your medicals have been received, if your security background check has been done, etc. If those things have NOT happened, you can then follow up with the visa office on them.

I am also having some trouble with them. At the time of the medical examrequest they also requested a background check by the RCMP which took months for them to complete. The RCMP completed the background check on December 31 2012 and send the results to the NY Visa Office.
My medicals were received in early December.
Since then nothing has changed. The file is still processing.
When should they havea decision ans request my passport?
