***** CANADA LANDING WHILE APPLIED I485 AND Having AP and expired H1 visa*******

Hi,

I am currently in the USA.I have applied for adjustment of status 485.Also i my H1 visa is expired and i am currently holding ADVANCE PAROLE Document.Also have my EAD.

I applied for Canada PR and also got the visa stamped on the passport.I just have to do the landing and the last date is 20August'2008.

Request anyone on this forum to please kindly advise me on how to proceed now....

1.Will i have any problems on the US side while entering after completing the landing process?

i am very confused and tensed up too....running short of time and also i spent money on the PR process and dont want to loose it at this stage.

Any advise is highly appreciated pls.

If you got your PR why bother, you applied because you're looking stability don't you? if you return to USA you'll apply for you tourist visa as everybody else, cross the border and enjoy your new life, we're after you some day too.

Technically you should not have a problem since you have Advanced Parole (covers your abandoning your 485 application once you leave the country)....but as with all immigration there are no guarantees!....just get and keep all your documents together and go...
Simply go, land and on your way back indicate you went for pleasure (be careful not to volunteer information that you landed as a PR to US guys) ..

Stop fretting and just go. Advanced Parole covers your trip in and out of the US while you await your I-485 once your H-1 has expired. That is what its there for! That is not an issue.

Just go to canada for your landing. You surely have worked hard and spent too much money to just let it slip away. Stay a week or however long u want and then return to the US using your Advanced Parole papers... Take all supporting documents along with you, and like qbanky said, just tell them you went on vacation!!!! You are not doing anything illegal...
