CAN+ Visitor Visa Online Application Refused twice, Bryanna need your help!

Hi Bryanna,

I applied for Canada Visitor Visa on Oct 11th under CAN+ Program, as i have a valid US 10yrs Visitor Visa, and got reply from CIC on Oct 20th saying that my application has been refused. The only supporting document i had to give was the scanned copy of my US Visa with the entry/exit stamps, and the Letter of Explanation, as these are the only documents CIC requires for the applicants who have visited the US in the past 10 years. The reason for refusal they wrote said:
You have not satisfied me that you would leave Canada at the end of your stay as a temporary
resident. In reaching this decision, I considered several factors, including:
Length of proposed stay in Canada
Purpose of visit

They made the decision at New Delhi Consulate. Now for length and purpose i only said in the Explanation Letter that "I would like to visit Toronto, ON, Canada, for Christmas Holiday for 1 week.", so i'm not sure what else i was suppose to write to make them believe me. So after that, i applied again on Oct 23rd, changing nothing else but the explanation letter with more details about my trip, i still wrote 1 week as i want to visit just for 1 week, i also included day by day itinerary, and again they replied on Nov 28th with the same saying my application has been refused, now the reason they wrote for refusal are:

Purpose of visit
Employment prospects in country of residence
Current employment situation

Now they made the decision at Chandigarh Consulate, even though i clearly mentioned in the Explanation Letter that "Please kindly process my application at New Delhi Consulate.", which they didn't. I work as a Designer and run my own company, The Employment prospects and Current employment situation they wrote weren't wrote by New Delhi Consulate, so i have no idea what made Chandigarh Consulate doubt my Current employment situation. I don't think i should've got refusal both times i applied, nor i think i got a right decision made.
So Bryanna, is there anything wrong i did with my both applications? What should i do or what should i write them to get it approved?

What documentation did you provide to demonstrate that you have your own business?

It's not up to you where the application is processed. This is CIC's decision.

They have no option there for me to upload any documentation for anything else other than Letter of Explanation, so i can't really do that, all i can do is write about my business in the explanation letter, which i did. As you may know, applicants applying under CAN+ Program can't provide any supporting documentation but just the US Visa scanned copy with entry/exit stamps and the explanation letter when applying online.

Hi,

Sorry to hear you had two TRV refusals.


Point 1:
There's some overlapping of the regions/areas handled by the NDVO and the Chandigarh visa offices.... which explains why you received TRV refusal letters from NDVO and CHD.

It seems you have applied online.... there is no information on where online applications are presently processed in India.


Point 2:
A common misunderstanding among CAN+ applicants is that they do not have to submit any documentation/evidence of strong ties or financial situation.... and they mistakenly believe that only proofs of their previous US visits will suffice. This is a huge mistake.

Previous US/Canada entry/exit stamps under CAN+ means faster processing.... it does NOT eliminate the need to provide documents/evidence that the applicant has strong ties and will return to the home country.


Point 3:
Reapplying with the exact same documents after a previous refusal.... will inevitably result in more refusal(s).

You MUST address the reasons for the previous refusal(s) before you reapply.


Point 4:
You can combine all documents/evidence as one PDF and upload this.... instead of just the Explanation Letter. What works are explanations if these are supported by evidence..... and not just explanations.


Documents:
What documents will you submit to prove you are self-employed?

Proofs of your financial situation.... to confirm you have the finance for your visit?

Do you own property/land/commercial premises..... or any of these on lease/rent?

Do you have family who live with you?

Is someone inviting you to Toronto?

Other than the US, have you visited any other country in the last 10 years?

Yes i applied online.

Point 2-4, yes i understand that, but when you apply as a CAN+ applicant, these are the only documents you get to submit - Application Form, Supporting Documents - Passport, Family Information, Travel History, Digital Photo, Optional Documents - Letter of Explanation. So as these are the only documents i was required to submit with my application, there weren't any other optional documents which i could give or upload to show my ties or financial situation. Do you mean i can upload the supporting documents as one PDF where you upload the Explanation letter? Even though they are not required? Would it help getting me a visa?

Documents, I am a Freelance Designer so i can't really give any documents to prove i'm self employed, but i can write my website link in my explanation letter, just if they want to see my portfolio, so let me know if i can do that or what can i submit.

Yes I have $10,000+ in my bank account, with statements from more than past 3 years.

No i do not own any property or land, i live in a rent apartment.

Yes my whole family live with me and is in India.

As my previous applications, no i didn't tell anyone to send me any invitation, I applied just with my hotel reservation, but if you think that getting a invitation letter would help me getting an approval, i can do that, please let me know!

Other than the US, i haven't been anywhere else, just the US in 2010.

Yes, you can upload supporting documents as one combined PDF file.

You're quite mistaken. Supporting documents/evidence are required to prove you will return to India.

Yes, it will help towards a positive assessment of your TRV application. No guarantees though that you will get a TRV because it depends on the nature of your supporting documents.

Business registration documents (Shop Act License, Service Tax registrations as a Designer) + ITRs for the last 2 years + company bank statements for min. 6 months to prove you actually earn what you claim + payment stubs for client payments/bank transfers + Service Tax Returns filing for 2-3 years + client contracts/purchase orders + ongoing projects you must return to


CIC is wary of freelance/self-employed professionals because they can travel/work anywhere in the world, anytime. You may want to prove you will not work as a freelancer during your visit as this is illegal + you must return to India by an XX date.


Do you have credit cards? Low credit dues? Good credit spending limits?

Yes on the website link there is everything about my company, work etc. I don't have any Business registration or anything like that as i'm a freelance designer, i can give only my website link as you're saying, which CIC can check without any doubt. How can i prove CIC that i will not work as a freelancer during my visit? Should i write a date in my explanation letter or anything? No i don't have a credit card, just debit.

No they are not financially dependent on me, my family spend their own, i do of my own.

You should also submit a day-by-day itinerary with expense estimates to prove you are a visitor/tourist. You'll have to Google for details.

I did submit day-by-day itinerary when i applied, but not with expense estimates, and it didn't help at all, do writing expense estimates with day-by-day itinerary gonna make any difference?

Invitation Letter from one of my close friends, yes they will provide proofs of the immigration status + other documents.

So just please let me know if i am eligible to get a TRV as my situation, or if i should apply in some other category like a work visa or something, because i don't wanna waste any money or time on this, just want your advice.

Hi,

IMO your chances of getting a TRV are low. Also, it is incredibly difficult to get a Work Permit.


To answer your questions:

No business registration, no proofs of work/taxes paid/income earned = Zero employment ties


No i don't have a credit card, just debit
Credit card(s) would have proved you are credit worthy + your income is verified by the credit card providers

Yes, expense estimates matter.... you would be able to prove you have the finances to support your visit.


You do not have any strong ties + you are unable to prove your employment (even as a freelancer). I suggest you do NOT reapply for a TRV until your professional and personal situation changes significantly
