hey there,

unfortunately my wife and i are nearing seperation. i am a canadian citizen and she is a us citizen. we have a house in northern bc where weve been living together for the last few years. our son who is 9 months was also born up here. she keeps threatening that she is gonna leave and take him with her, and acts as if i have no right to stop her. if she leaves she will be moving back into her parents house as she has no ability to take care of him on her own.

what are my rights in a case like this? i know when she went home to vvisit with him i had to get a letter of apporval notarized for her to take with them. can she just up and leave without my permission (permission to take the son, she can leave on her own all she wants). i find it hard to see how she would be given that right to take him, 5000 kms away for that matter. i have a good stable job, a nice home for him to live, etc.

please let me know what i may be looking at here.. thank you.

Talk to a family lawyer who will explain your rights. You spouse cannot just pack and move with the child.
