My spouse and I (main applicant) applied for EE a while ago and are still waiting for the decision. In the meantime, I have a PGWP valid for 2 more years, and she has a study permit valid for 6 more months. She will finish her degree in those 6 months, and she already used her PGWP (expired by now).
My question is, can she apply for a Spouse Open Work Permit now, since she's my partner and I have a work permit, even though she's still a student with a study permit? Can she have both at the same time?
Also, can she apply for an open work permit, just for the fact that we're waiting for our PR, or only the primary applicant can do this?
We're hoping to do this, so she can stay and work while we wait for our PR, instead of her having to leave the country after she finishes her degree.
I know she can apply for a Spouse Open Work Permit after she's done her degree, but I'm not sure what her status would be from that time until she gets the work permit, and whether she has to leave in that period.
