CAN MY FAMILY ENTER CANADA VIA ETA AND START SEARCHING FOR MOST VIABLE WAY TO IMMIGRATE FROM WIHIN CANADA?

Hi, my family and I want to immigrate to Canada and we have passports and ETA ready, but its of great importance we leave our country due to security issues; can we enter Canada and start immigration process form within Canada? Somebody told me that if we request refugee status we could not return to pur country for at least 5 years but my oldest son is about to graduate from his university; he would have to return for a week within 6 months to a year to present his thesis. What is the best way to immigrate without being limited travel to our home country. Thank you.

If you are from an ETA country and your son can return to complete university then you are most likely not refugees who would claim asylum. You need to show that you are in fear for your lives - police/hospital reports, emails, letters etc. Immigration is based on age, education (need ECAs), language (IELTS) and skilled work experience. If you have a child in univeristy, due to age, you may not be even eligible for immigration programs. You can look at immigration programs while in Canada but it can take years. Also how old is your son? If over 22, he is not your dependant and must be eligible on his own merits. If he has a year of work skilled work experience, strong English skills and is well educated then he may have a better chance of immigrating than you because he is under 30. Immigration benefits young people.

The refugee path is not a good option based on the information you have provided. If you pursue this path, you should expect that you'll end up separated from your son for many years (your son will end up stuck outside of Canada without the ability to return) and travel back to your home country will not be possible for a long time. It's also of course unknown if your refugee claim will be accepted. For this reason this is a very risky approach and you'd have to be prepared to accept the consequnces of filing a claim.

Best option is to apply through an economic immigration stream like Express Entry. Then you will face no travel limitations. You can find more information about this program here: https://www.canada.ca/en/immigration-refugees-citizenship/services/immigrate-canada/express-entry/works.html

Before you travel to Canada, I would also recommend that you confirm if you are in fact eligible to apply for PR through an economic immigration stream and how long the process may be to be selected and approved. Living in Canada is extremely expensive without the ability to work and without health care coverage. If you simply travel to Canada, you may find that you run out of funds very quickly and well before you get PR.

You haven't said how old your children are. Note that once your children are 22 years old, they are no longer classified as dependents for the purposes of immigration and will need to qualify to immigrate on their own.

You need to understand that refugee claim is for people who have danger if they return to their home country. So it doesn't look like you fit that if you do want to return. It may be more than 5 years that you cannot go back or use your passport if you want to claim as refugee. (you should not travel back or with the passport even after you become PR. It's only OK after you become Canadian citizen and travel with passport. But many wouldn't travel back because they are fear for their lives back in their home country)

As for family unit, IRCC only see applicant, spouse/common law partner and their children under 22 years old as family.

So it's unlikely that your eldest is part of the family if you decided to claim asylum in Canada.

Thanks for your prompt replies; my son is 21 this week , my other 2 children are 19 and 17....all at university level; Im 51 I have a BA in Bilingual education and have worked as a teacher at university level. I m also an OSHA trainer and auditor, and have worked as a safety specialist in the construction and manufacturing industries for the last 20 years.
Another question....if I search for a company to endorse me how can I apply for a job? I ve searched several websites like Indeed, and also the Designated Employers programs for several places like BC, PEI, SAS, etc...but all of them ask if I´m authorized to legally work in Canada... how can I get a company to hire me even if its registered as a desginated employer to hire foreign workers.

The company has to prove they can’t hire a Canadian.

You need a job offer and your employer needs to file for and pay $1k for a LMIA. The LMIA shows that no Canadian or PR could be hired, only Then with LMIA, you apply for a closed work permit. For the permit, you show that you are experienced to do the job. The process can take many months. Few employers go through the process unless they can’t fill the job within Canada. So if they are stating that to apply that you must be authorized to work in Canada then it is safe to assume they don’t want to go through the LMIA process.

Assume you are Mexican. Would also add that to claim asylum you have to show that there is nowhere in a Mexico where you’ll be safe and you have relocated within Mexico seeking safely already. As already pointed out having your son still studying in Mexico will indicate that you don’t fear for your lives and had not other choice but to leave.

You can attempt to see if you can get a teaching job although likely at an elementary of high school level. I would explore provinces that are in the most need for teachers especially in places that are more remote. I know some reserves hire their own teachers and seem to be more flexible with licensing. You will need to contact every province to determine whether you’ll be able to get licensed as a teacher. Are you aware that your children will need to get study permits and pay international fees to attend university in Canada even if you get a work permit?

Hi, thank you for sharing your thoughts and comments; I think that the most viable way would be through a self employed process, after searching in the NOC CODE I believe that I do fit in some of these profiles with my experience and degrees and certificates. According to the point grid; I would be getting between a 60 and 75 out of a 100 points; which I believe is a minimum of 35 points in this scale to be admitted into Canada.
The quesiton still remains if I can do this process from within Canada, taking into account of having sufficient funds for the months for the process to advance, and if my kids would be able to study through a student visa.; since insecurity is high at least for the time being;
I would appreciate any comments on these.

The Self Employment program is one of the hardest and longest processing programs that accepts around 1000 per year, and has probably 10x more applicants than spots. What is your NOC? This program is for people in the arts or sports fields. Writers, musicians, coaches etc.


Processing is about 3 years. Go on the Business Immigration forum to read the threads. You need to prove you can be self supporting through your business in Canada. So you need to show that you have been as an example a write and been self supporting for a number of years without working for an employEr. As visitors, your kids cannot study until you are accepted into the program and get AOR. If you want them to study, apply for study visas and pay international fees.
