Can my brother sponser me and my common in law?

Hello,
I have been recently started looking into getting my PR in Canada and noticed this sponsorship visa.
I am currently living here in Van city on a 2 year work permit, along with my common in law partner.
My brother has been living and working in Vancouver for 4 and a half years now and is a PR.

My question is, I know as his sister he can sponsor me but can I take my partner on that visa also?
We were looking into the express entry system originally but now this family visa is looing like an option for us.
We both live and work here full time for nearly a year now.

I can see a lot of questions here about spousal sponsorship but has anybody go through this as a sister/brother? With a partner of their own?

Any help would be appreciated, Thank you! :)

Brother can only sponsor you if he has no family of his own. check the http://www.cic.gc.ca/english/immigrate/sponsor/relatives-apply-who.asp


You can sponsor one relative of any age or relationship, but only if you do not have one of these living relatives who could be sponsored as a member of the family class:
•spouse or common-law partner,
•conjugal partner,
•son or daughter,
•parent,
•grandparent,
•sibling, or
•uncle, aunt, nephew or niece, and

you do not have any relative who is a:
•Canadian citizen,
•permanent resident or
•registered Indian under the Indian Act.

Yes I read that section online earlier but it is not making much sense to me! So he has no family of his own he's a single guy.
I take it that where it says "you can sponsor one relative of any age or relationship" that my relationship to me partner may be covered on it to?

"only if you do not have one of theses relatives who could be sponsored as a family member" I am his only sister but yes we have parents, grandparents uncles, aunts? Or do they mean Canadian parents, grandparent, aunts, uncles... I'm confused?
Maybe its just too early for me to be looking at all this! :eek:

Are either of his parents alive, anywhere in the world? If so, he cannot sponsor you.

Yes. Our mother and father are both alive but never intend to move to Canada.
It says sibling on that list too so really they backtrack on their own words. "You can sponsor ANY relative of any age or relationship" as long as you do not have any other relative alive?
Or do parents just get top of the list?

Yes, parents come first. They "trump" siblings. Sorry...

That is ridiculous, we are brother and sister at the end of the day. Couldn't get a closer family member!

I think ill pop into the embassy and see what they have to say on it all.

Family class sponsorship is not meant as a backdoor to Canada because you have family here already.

He can sponsor his parents or grandparents, which can in turn include you on their application if you are under the dependant age cutoff (19 I believe).

Family class sponsorship is aimed at mainly sponsorship if spouses and children. Parents are permitted as they may be able to provide additional support services for a new family (allow both members to work while the parents look after any children) and their children can be included in that if the are dependant on their parents.

I would honestly love to see the Family class divided into three parts:
- Spouse (Processed semi-fast)
- Dependant Children (Processed within 1 month)
- "Other Family" (Parents and Grandparents)

Speaking as someone who is sponsoring their partner, and as a Canadian. I don't feel my marriage to my partner should allow my parnter's entire family to immigrate to Canada. It should definitely count for something, but they should be permitted to immigrate on their own merits only (skilled trade and work experience, education).

I do think there should be a general "no skilled work experience but I would like to immigrate anyways" category which would be similar to the express entry points system and give points for Language Ability, Adaptability, etc but ignore employability. That said, the fact is, that would be possibly used for people to immigrate to Canada and take advantage of the welfare system, which is also part of why Family Class is so limited in scope right now. The restrictions that are in place are in place for the benefit of Canadian Tax payers and not to benefit anyone else.

Go ahead and pop, but you'll get exactly the same answer. It's quite clear and straightforward. You only have 1 spouse, 4 parents and 8 grandparents and whatever dependent children and spouses they have. You can have any number of siblings, your parents could sponsor your aunts and uncles, and the web would allow theoretically everyone in the world to come eventually. Basically, if you aren't caring for or being care for by your sponsor, you need to qualify on your own merit.

Some of the provinces have a provincial nominee program where a sibling can sponsor a sibling. I don't think BC has such a program at the moment.

Those are points based systems. If you don't have formal eduction or in a skilled profession you won't have the points required to be nominated.

You are here on a work permit that is good for two years, right? You are probably better off getting PR based on your own merit? Sibling sponsorship IS going to be a long and difficult process, and your common law would most likely have to wait for YOU to become a PR first, and then get sponsored by YOU.

That's not how the system works. When you apply for PR, all your dependants, (partners and eligible children) are examined and must be part of the same application, even if they elect not to immigrate (non-accompanying).

Well yes I know we include family info in our app but how does that relate to sponsoring siblings though? All that shows is that they are related, period. Sibling sponsorship IS more complicated than spouse or parents, or is that not how the system works?
