here is the case
I am a Canadian citizen, he is an international student of United States, he has overstayed in US for about 4 month now and he is still in us because of a bunch of reasons. He is coming to Canada and going to live with me for the rest of his life, that's for sure, but he hasn't got any types of canadian visa yet, and we are wandering if he can just apply for a visitor to get married with me in Canada and then I can just sponsor him to become a Canadian permanent resident, would that work?

If the can get the TRV approved, then this will work.

However the fact he has no status in the US will likely make it very difficult to get the TRV approved.

A few other comments... I would personally wait until you know the outcomes of the student visa application before you apply for the TRV. If the student visa is refused the TRV most likely will be as well as long as he remains in the US.

As for his stay in the US, he wants to make sure he leaves the US BEFORE he has overstayed for six months. Once he has overstayed for six months or more, he will automatically have a 3 year ban from the US. If he overstays more than a year, the ban increases to 10 years. He will want to avoid the ban and leave before his happens, even if that means returning to his home country.
