Can LMO be exempted if I have applied for PR?

Hi All,

Currently I'm in Canada through work permit and I have applied for PR in 2010. Now my work permit is expired and my company is filing for an LMO which is lengthy process. Do i really need an LMO if I have applied for PR? My NOC in PR application and the current NOC for LMO is different.

Kindly suggest Seniors/experts.

And yes - you need an LMO. Applying for PR does not exempt you from requiring an LMO.

Yes...you require a visa and have to maintain it if you have applied PR under FSW. However, since you have not provided detailed information as regards to length of your WP or under which category you applied for PR, it would be difficult to answer. Hope this helps.

In a nutshell , you will need to continue to hold a valid work permit until such a time when your PR is granted and you compeleted the landing process.

Thanks a lot for the response. I clearly understand that I need a valid work permit to work in Canada until I get my approved PR and I land in Canada. My question was specifically for LMO approval. My current work permit is expired and to extend the work permit, I need to get a positive LMO which is really a time consuming time now. Just wanted to know if I can extension can be done showing the PR application which is in progress?

Any inputs please?

Not sure if your Pr application which is still in progress can influence/hasten the processing of your LMO.However,with the new rule(hrdc)LMO can be processed within 10days if employer has shown compliance with LMO regulations with the previous employee.
