Let’s talk about you returning back, not to USA, but to school – fifth grade preferably. Canada does not need illiterates.

Ok so the answer to your question is no someone on a visitor/tourist visa cannot apply. The only way to apply while being illegal in the U.S. is if you have been in the U.S. legally for at least 1 yr. (tourist visas don't count) BUT even if your friend was able to apply they might get some hard questioning during the interview. I've posted on this previously if you need more info let me know.

Thank you for the important information, he is working for me from the last 6 months amd he is graduate with wife and a kid. Back home his family situation dont allow him. I just wanted him to get some status otherwise he is on USA mercy.
