can i work in canada with lmo, after deportation ? Please hep :(

Hi everyone, i am new in this forum and i found it very helpful. I hope someone can help me :(

So here is my story, my refugee and humanitarian application were refused. Then i was ordered to leave canada in september 2012, under departure order become deportation. I did leave, showed up at cbsa office to report and i received my certificate of departure.
CBSA officer told me that i have a chance to return if i can get LMO from my employer. She said that i need to apply for work visa once i get my lmo (im from a country that doesnt listed for visa exempt) and ARC once i get the copy of the LMO file number.

My employer did apply for A-LMO and received a positive high skilled LMO in october 2012. so far so good.. until i see the "Level of Education", my employer required a college degree (I applied for hotel front desk agent at first but then i was promoted as front office supervisor).

Do i still have a chance to return to work if i dont have college degree ? If i attach my employee of the month, certificate of completion this and that course provided by hotel, reference letter from my general manager and previous hotel job, does embassy will consider my applications ??

Please help :(

1. You are going to have great difficulty returning. YOu don't meet the requirements of the LMO, you were deported, the chances of a VO issuing a work permit are close to nil. The reason would be that the VO would think that temporary work is not a sufficient reason to issue an ARC and that it would be unlikely that you would return to your country of origin when the TWP is over.

Hi PMM, thanks for replying.

I was on grade 7th in university but then left to canada to apply refugee. I have a proof stating that i was a student in this university. if i attach these documents with my applications, would that help ? :(

Since your employer applied already an LMO for you but then how unfortunate the educational background is higher than you have why not give yourself a try and exert all your effort to present all the sensible documents that may qualify you for the position since "you've been there and done that"...

As how I read all the blogs here about A-LMO; it caters to NOC O, A and B. Likewise the educational qualification and work experience of NOC Level O, A, and B must be consistent to to it's advertising and how an A-LMO must be in terms of information drafted on.

It will all boils down to the assesing Visa Officer if your working at your employer before will ever be considered.

If becomes denied, your employer if still willing may re-apply again for a regular LMO sponsoring NOC Level C and D to make it more consistent and reachable to the educational qualification and work experience as how it will be described.

how to apply as a refugee??

is it a big help for a temporary foreign worker to apply for it and allow to re enter canada after overstay???

what if got an LMO Approved, apply for temporary resident visa ( TRV visa in the PHILIPPINES ) , is there any chance to approved an

application for work visa to return to Canada?

So I did apply for my work visa. I attached all possible documents that could support my A-LMO, WITHOUT college certificate. 5 days later, I received a NEGATIVE result.

The reasons of refusal are :
1. You do not have a college level diploma or certificate as specified on the LMO
2. I am not satisfied that you will not seek to remain in Canada.
3. You are inadmissible under section A52(1) : ARC denied.

My employer has open LMO for another department (housekeeping) which I am not willing to do so. And he offers me to apply for regular LMO for Front Desk Agent, which is my department and more than happy to take the offer.
But then, there is another hotel (same chain, different owner) who is willing to offer me a job with open LMO.
I am so confused what I have to do :(

1. If I take the open LMO for housekeeping ? Don't you think the embassy will think that "She doesn't care what kind of job, she only wants to return to Canad and remain in Canada."
2. If I take the offer of regular LMO, it will take 3 months to get the results. Do you think Canada Embassy would consider my application if the LMO comes from the same employer, and lower position ?
3. Should I take the offer of open LMO from other hotel ???

What is the best option I should take ?

And, HOW AM I SUPPOSE TO CONVINCE EMBASSY THAT I WILL RETURN TO MY COUNTRY ?? I just want to get more experience in hotel industry, as I want to find a better job in bigger hotel in my country and to be with my family at the same time.

Any advise would be much appreciated. Thank you.

I think you will be refused again no matter how you apply. Given how recent your deportation order is - I don't see how you can possibly show strong ties to your home country. Applying so soon after your departures just further proves that you have no/low ties to your home country.

If you want to return to Canada, I would recommend that you remain in your home country for at least a year (possibly more), re-establish your ties there and they try applying again once you can actually show ties.

Hi there, thank you for replying.

I totally get what you wrote here. I mean, while I have the opportunity to work in my field and to have more experience in Canada, why not take it ?? As it is hard to find any job without College Degree Certificate in my country. All I can offer are experiences and skill :(
I also planning to get married with my boyfriend who is the same citizen of my country in about 2-3 years, which I will absolutely return to my country after my contract is done to get married.

Do you think it is a proof that I will return when my contract is expired ?? :(

No - I don't believe these are strong ties. However you can always apply and see what happens.
