Can I request the VO/IO to not count my work experience from 1 specific company?

Hi,

I have received an ITA and am in the process of collecting my documents. I am in a situation where one of my past employers is acting in a hostile manner with respect to providing the roles and responsibilities letter. I have worked at 3 companies so far, and this is the 2nd company (total experience of 1 year). The management is being very smart and I do not have written confirmation from them that they will not provide the roles and responsibilities letter (all communication is being made over telephone, that too in indirect language).

Obviously, work experience (hours and NOC) are an important aspect of the CRS and FSW points calculation. However, I estimate that if I were to leave out this 2nd company, there would be no change to either my CRS points or my FSW points (explanation below):

1. 1st company - Primary NOC 2171 - Experience of 2.5 years
2. 2nd company - Primary NOC 2172/2161 (whichever is better for "Data Scientist") - Experience of 1 year
3. 3rd company - Primary NOC 2172/2161 - Experience of 1.2 years

By applying without including the 2nd company, here is how the points add up:

1. CRS - 3+ years of experience based on my 1st and 3rd company (employment gap doesn't matter based on this post)
2. FSW - 2 - 3 years of experience based on 1st company alone. (sufficient for 68 points)

Since the 2nd company's information is not crucial for me from the perspective of points, can I somehow communicate to the Visa Officer that "I worked in this company, but they aren't giving me any proof and it's OK if you discount that experience since I have the points anyway"? I read elsewhere that omitting work history amounts to misrepresentation, so that's why I am concerned.

I don't have a lot of indirect proof either, as payment from the 2nd company often involved cash and I have an erratic salary credit history when I was employed there. This company was a startup with less than 7 employees and so did not have to pay Provident Fund contribution.

Any help will be appreciated!

Since removing it doesn't affect your point , just put it under your personal history and then upload a letter saying you couldn't get a reference letter from the Company

Based on the ITA form, I now see 2 documents for "Employment Records" -> "Employment Record 1" and "Employment Record 2".

In "Employment Record 1", I will be adding my roles and responsibilities letter from the HR of the MNC I used to work for.
In "Employment Record 2" (which was my startup that failed), should I add a letter saying this is just for "Personal History" and not "work experience"?

Any advise is appreciated.

Hi,

Just put it under personal history so far you are not claiming points for it. Then put an LOE in the section explaining you wont be claiming points for it

I'm also not seeing any where that states " personal history" . Where exactly is this?

I didn't see personal history either. I just uploaded the letters that I am claiming for
