Hello,

I'm knew here and I need some advice. Please read carefully before responding.

I am an international student with work experience. Is it a good idea to apply for refugee or for Humanitarian. I can't pay tuition (my funding got cut off). Any one out there went from being an international student to Permanent resident (before graduating).

I live in Toronto. I am open to all ideas. Please help thanks.

How you go from student to wanting to end as refugee or H&C? Why don't you try getting a work permit, get some experience, and apply under CEC class?

Ok. This guy came into Canada as an international student. Now instead of fulfilling his commitment to finish studies, he is seeking to get PR and he is thinking about taking the humanitarian or refugee route to do that.

I have no problem if someone wants to immigrate here. I am one myself.

Also, I thought if you were a full time international student in good standing, you could apply for work permit and eventually work towards getting a PR through skill category. The current system seems to favor them as they are perceived to better assimilate into Canadian system.

As someone who came here as a student, got an off-campus work permit, and then got a Post-Graduate work permit, this is a bit odd.

FYI guy go that route, talk to your international student union at your school.

H&C will fail. Being unable to pay tuition will not be considered as a reason for being approved under H&C.

As for applying as a refugee, it sounds like you want to use the refugee program as a means of remaining in Canada. CIC will likely think this as well. If you can't prove that you yourself are in danger then assume the refugee claim will be refused.

Note that a refused refugee and/or H&C claim will make it much more difficult to re-enter Canada again in the future.

Can we do the online payment here? meaning I will be the one to do the hands on and my husband will be on the phone from Canada to give me the visa card number?

If we can, will I still click on payment made from Canada?

We're planning to do this next week if no one could help him there...

you can do online payment from anywhere in the world. It's called payment "in canada" because your application will go to Mississauga first, it doesn't refer to where you are when you are making the payment. You don't need to be in Canada to do it, so your husband can do it directly through CIC website, choosing the "in canada payment" option, and using a foreign credit card.

If you want immigration advice that remains confidential, there are community legal clinics in Ontario. I think legal advice is essential if you're thinking about a refugee or H&C claim. There is also legal aid for low-income people.

I agree with the above poster. If you really want to try to claim H&C or refugee status on the basis of this "gang related death threat", you will need to contact a very good immigration lawyer. Given your situation, there is not really anything that anyone on these forums can tell you beyond that.
