Can I include my son in my PR application under FSW? He is already in Canada under student visa

I am planning to apply under FSW category. we are 4 family members including myself, my wife, daughter and son. My son is currently studying in Canada under Study permit. While creating EE profile

  • should I include son and mention number of family members 4 or should I exclude him because he is already in Canada hence cannot appear for visa stamping?
  • Furthermore, If my son cannot be part of my PR application at this point, can I sponsor him at later stage once I get my PR approved?
  • If I cannot include my son at the moment, in that case should I mention family members in my profile as 4 or 3?
  • Would Canadian Embassy ask for my son to be physically present with us at the time of visa stamping and PR approval if I include him in my PR application?

Please advise. I am unclear what should I do in this regard?

As long as your son is under 22 and unmarried (and not in a common law relationship), you include him as a dependent in your application. It doesn't matter where he is physically.

You must list him as a dependent in your current application and he must undergo a medical. You can list him as non-accompanying and sponsor him for PR later. However he must complete all application procedures like the rest of your family as part of your original application (otherwise you will not be able to sponsor him later).

One more small query. Since we are not immediately applying for his PR and he will not accompany me at the time of entry in Canada, In that case do we need to go for his Police clearance also? his 18th year is running. He will be 18 years old coming March 2019.

Yes - everything is required including the police clearance.

Thanks for the advise.... I will include him under my application and as I have understood from the conversation above, will have to submit his documents including his Police clearance. His 18th year is running and will complete 18 years in March 2019. we are Dubai resident and Indian citizens.

In that case should I mention my son as accompany? How about visa processing formality? won't be able to deposit his passport as he is in Canada at present under study visa.

You should include him in youe application as acvompanying without worrying about how he is going to stamp his passport....those already in canada are give a copr...confirmation of permanent residency....and they can complete landing formalitiea by driving to the USA border and re-entering canada. Takea 15mins.
Dont be wasting your time and money by including him as non accompanying...you will have to o through a lengthier process to sponsor him later on. Better get it all done in one application and make things easier for yourself.
