Can I extend/replace PGWP to get an open work permit?

Hi there,

I am studying in Manitoba under the post-graduation program and will finish my course at the beginning of 2020. It means that I have one-year PGWP after graduation. I intend to apply for Express Entry after getting one-year working experience or applying for Manitoba's provincial program.

My boyfriend who is gonna become my spouse this year is getting working holidays visa to go to Canada at the beginning of 2020 as well. However, he wants to work in Toronto, not Manitoba because there are lots of opportunities for him rather than staying in small cities. After that in 2021, he intends to study at one university or college for one year.

The question is how can I move to Toronto with him next year without fear of having not enough time to apply for Express Entry program. It takes me at least 6 months to find a job and settle down in Toronto, so I almost cannot do anything within 6 months left in my work permit. No one will hire me, and consequently, I cannot gain enough 1-year working experience to apply for Express Entry.

Is it possible for me to extend my PGWP under the sponsor of my spouse's study visa? Otherwise, can I get an open work permit under the sponsor of my spouse's study visa when my PGWP is not valid anymore? Because at the end of the day, I need to try to extend my work permit in Toronto as long as possible so that I can have enough time to apply for PR.

Thanks so much!

It's not possible to extend the PGWP. If you and your boyfriend get married, then you could apply for a Spousal Open Work Permit as long as he has a job that is NOC A, B or 0 skill level and can provide 3 pay slips and an employment letter to prove he has a job that meets these requirements.

Thanks for your prompt reply. As mentioned earlier, when my PGWP expired, can I apply to open work permit under the sponsor of my spouse’s study visa?

Yes - provided you are married.
