Hi
i want to know that i apply my Pr case through outside Canada and right now i am living with my Canadian wife in South korea she is teaching here and i am on her spouse visa i am Pakistan national, now my question is my wife renew her job contract in korea because we don't know when manila will contact us for visa if manila give us visa before my wife job contract end in march 2015 can we move to Canada and she come back after one week?
or i can go alone and get my PR card and come back to Korea and when my wife job contract end in march 2015 we both go for permanently or if you have any good idea pls share.
when my wife filing sponsorship application CIC ask her when she will resettle in Canada on that time she mention when my husband get his PR VISA so if i go alone to Canada Immigration will ask me where is your wife so what i will reply can i say that my wife is completing her job contract and she will come after some months ??

If CIC don't believe your wife will relocate to Canada, they will either ask for proof or will refuse your application. Apart from that, you are unlikely to have any problems.

I also hear that people go there and come back after taking PR card and other cards for completing there job contract or some other work and then back to Canada after some time.

The people who do that are the actual PR applicant. But it is your wife, the sponsor, who wants to do this. The problem is that your wife needs to convince CIC that she has real concrete plans to move back to Canada. Things like signing a lease or have a job offer in Canada looks good. I don't think just a money transfer will be enough. They will want to see some time of proof that will physically tie her to Canada after you land.

we already submitted her family support letter witch was notary public attest and her family declare when ever my daughter and his husband want to live our home they can live and settle in Canada.

I want to know that how CIC that she is going back for completing her job contact?

also she will stay at lest one week then she will go and come after 6 months I also go back to Korea and then will come with her.

I have heard of people landing alone in this situation while their sponsor stayed outside Canada and no questions were asked but if you get an immigration officer in a bad mood, you may have a problem. It would be safer to travel together for your landing.

I, for example, landed on my own, while my sponsor was at home in the UK. No problem...

yes we will travel together but after one week she want to come back and complete her job contract then back to Canada.

It is not a requirement that your wife accompany you when landing, so that should be ok if you land alone.

However if you have conditional PR status, you are expected to cohabit with your sponsor for 2 years after getting PR. If you plan to land as PR then BOTH of you go back to Korea to finish work contract, that should be ok.
But if only your wife intends to continue working in Korea while you stay in Canada, that could be a problem since you wouldn't be cohabiting.

Hi Rob, doesn't the rule state that sponsors who were outside Canada during the application process, must demonstrate that he/she will relocate to Canada once the sponsored spouse gets the PR? If they (especially the OP's wife) go back to Korea (i.e.: within weeks since first landing), won't the wife (sponsor) violate that rule?

No, there is absolutely no rule that states a sponsor must remain in Canada, or even return to Canada in the first place.

Yes a sponsor living outside Canada needs to show intent to move back to Canada during the application process, but once the PR is actually approved they are free to do whatever they want. As long as they are cohabiting anywhere in the world there would be no problems whatsoever. Often plans change, and CIC can not dictate to Canadians where they must live.

Ah I see.....makes total sense =). A little bit of a grey area, I suppose...somehow confusing....

So even though the OP's wife will be showing proofs of intent to relocate to Canada once the OP gets his PR, it's actually okay for the OP's wife not to fulfill what she promised (relocating to Canada) then?
