Can I apply Temporary Work Permit without FBI PCC. LMIA approved.

My employer has done LMIA approved for me. But since I am working in USA & not a citizen or green card , my FBI Police clearance will take 12-14 weeks. The lawyer says they can apply work permit without getting FBI clearance just by showing just the fedex delivery receipt to get the temporary work permit.

I trust the lawyer, but has anyone been in the same situation ? Will the temporary work permit get approved just by proving that I have applied for FBI clearance ? Why I am asking is because there are many things at stake for me, so If I know that I will get thru without FBI PCC, I can plan my move to Canada from US.

Personal view and others can correct me but apply for versus getting approved are two different things.

Maybe can apply for the permit just showing have sent for the FBI check but it likely will not get approved until the check is completed else why have a check in any case should it be negative and the permit already issued ?
