Hi !
I'm in Canada with a Work permit but it will expire soon, I can't find another way to stay here longer so I'm thinking to enroll in a school and get a study permit.

Can I apply for a SP from inside Canada while I'm on a WP ?

If the process will take longer than planned, I must switch from WP to Turist visa, in that case... Can I apply for a SP as a Turist from inside Canada ?

Thanks !

Something I know:
Yes you are eligible to apply in Canada for an SP, before your WP expires. However if your WP expires soon there will be question about your real purpose as seen from the immigration office. It is likely that you just want to stay here longer, rather than really to study. So there is a risk (maybe a waste of time saying this because every case has its own risk).

If the process takes longer than you expected then you will be in "implied status", i.e., your WP expires but you haven't received a decision on your SP. You can stay legally in Canada but you cannot work/study as you are applying for a different type of residence. I think it makes little difference compared to a tourist visa. You cant work/study in either case, but just staying in Canada is fine.

In case you do switch your status, you are still eligible to apply for SP within Canada with a tourist status. The risk applies basically in the same way. Hope it helps.

Thanks a lot for your answer ! Loved your whole explanation !

About the risks... you mean they can refuse to give me a SP ?
I'm a skilled worker NOC-B but since it's hard to get a new LMIA I might want to get a Bachelor degree (I don't have one) and get even more skilled.
In your experience, do you think this reason sounds not fair enough ?

Also I don't have enough points for EE, so I might want to improve my english instead and attending just a full 1 year english course, which I need a SP. Does is it sounds risky ?

I was on Work Permit when I applied for a Student Permit last March 2016. My WP would expire by October 2016, and I know that there will be no more future for me to stay in Canada, that is why I opted a different pathway.

I was approved with a Student Permit by May 2016. I just made sure that I have enough money as proof of funds, which is my tuition fee worth $15,000 + extra money of $10,000 = $25,000. I also send them letters from my brothers that they will be the one to support me while I am studying. And of course the Letter of Intent which should be sincere why you planned on studying. I just took a one-year certificate course, but make sure your school is one of the designated learning institution.

Hi ! thanks for sharing your experience !
Can I ask you some further questions?
When you got you SP in May what happened to your WP ? since it still had 5 months of validity ?
Also, when you school program started ? between May and October or later?

I also don't understand how people receive the SP from inside Canada?
you have to go to the closer border or you just get it by mail ?

Thanks again !

The work permit is automatically invalid. I started school by September. So, I did not work since then. I applied online. It was a good thing that through my student permit I was able to sponsor my spouse to go here in Canada and got an Open Work Permit. He was the one who worked for us for the whole duration of my studies.

The reason is fair enough from my personal perspective. I mention the risk because I know a guy on tourist visa (expiring soon) and got refused for SP. I think that's because it seemed to the immigration office that he just wanted to remain in Canada rather than study. But wish you the best!
