Can H4 apply for canada PR?

Hi,

I'm on H4 visa n have better qualification then my husband which fits into the federal category. I'm I eligible for applying canada PR? ANy responses would really be appreciated.

Ofcourse you can. There is no law or rule which says if you possess an H4 visa, you will not be allowed to try for Canadian Imm. You can apply for the Canadian Immigration visa under its various options. I believe you plan to apply under the Skilled Category. Do go through the CIC website for the in detail process.

Hi,

I have around 6.5 years work experience in India. My last role, I was a project leader with an indian MNC for about 1.5 years. There were 15 team members reporting to me directly and I was partially doing the duties of Manager.
I am now in US on H4 visa and my husband is here on H1 visa. He is a peoplesoft consultant here and does not fall into the category.
So, we decided to apply with me as the primary applicant.
Looking at the above 2 messages, it looks like I can apply even though I am not currently working.

1. Can I apply even though my designation was not of Project Manager but I had 15 people as direct reportees and I was directly doing most of the managers duties?
2.I have been in US for 7 months while my husband is here for the last 3 years. Can we apply through Buffalo office?
3. I have worked in Canada on work permit for 7 months. Do I still have to take english proficiency test?
4. Does my spouse have to take it as well? He being the secondry applicant and also is here for the last 3 years? Does he also need to take it?
5. I was on L1 visa about 2 years ago and was working in Phx, Arizona for 7 months. The Arizona state does not issue police certificate. Do I need to do anything for that?


Please suggest. It would be of great help.

1. Your job title doesn't matter as long as it duties matches those in the NOC code. In your case, your duties on the job you want to claim experience on must match those of the corresponding NOC for Project Manager, it doesn't matter what your company called you. Take into consideration the NOC must be one of the 38 jobs in the Minister's list if you want to get PR, else you won't get it.
2. If you're going to be the main applicant, you need to reside for 12 months before you can apply to Buffalo, else you're gonna have to apply through the CIC nearest to the country you come from, i.e. India.
3. You should take it regardless, if you don't, you're at the mercy of the officer processing your case to assess your english proficiency. It's not much money for IELTS so why not take it?

The thing is that, we are going to be in US for the next 2 years or so. If we apply in India, wont we have to travel to India to get our passports back? Thats what I read that international shipping of passports is not done to\from India.
